With the rapid development of the economy and society and the rapid advancement of the construction of the social insurance system, the social insurance field is facing many new situations and problems, and the social insurance law urgently needs to be adjusted and improved in accordance with the times. During this year's National People's Congress, several representatives proposed a proposal to revise the Social Insurance Law and suggested accelerating the process of amending the law. Since its implementation on July 1, 2011, the Social Insurance Law has played an important role in promoting social insurance reform in China. However, in the past decade, with significant changes in social insurance reform and development, the shortcomings of this law have become increasingly apparent. The proposal believes that from the practice in recent years, there are some problems with the Social Insurance Law, which are manifested as: some legislative content has clearly lagged behind the development trend of social insurance reform; Some regulations have not been truly implemented yet; Some regulations are too principled and lack operability, etc. In view of this, the proposal proposes to clarify the leading department for the revision of the law, with the National People's Congress Social Construction Committee taking the lead in organizing the revision, or the Ministry of Human Resources and Social Security or the Ministry of Justice authorized by the State Council taking the lead in proposing the revised draft. All social insurance administrative departments should closely cooperate, fully mobilize the enthusiasm of academia and industry, widely absorb the wisdom of all parties, and provide strong organizational protection and intellectual support for the revision of the social insurance law. At the same time, clarify the basic ideas for amending the law, including: further clarifying the law enforcement subject based on the results of institutional reform, and assigning powers and responsibilities centrally according to different sub items of social insurance affairs; Clearly define the financial responsibility of the government for the social insurance system; Further provide actionable basis for the operation of various social insurance systems; Strengthen supervision, including legislative oversight, social oversight, etc., to ensure institutional safety and efficiency.
