Recently, the General Office of the Beijing Municipal Party Committee and the General Office of the Beijing Municipal Government issued the "Opinions on Strengthening the Connection between Administrative Law Enforcement and Criminal Justice" (hereinafter referred to as the "Opinions") in Document No. 1, 2024. The Opinion consists of five parts and 16 articles, including improving the operational system and mechanism of the execution linkage work, establishing a leadership mechanism, coordination and cooperation mechanism of the Party for the execution linkage work, a case reporting system, and a two-way case transfer mechanism; Strengthen the supervision of the execution coordination work, propose to strengthen the supervision of administrative law enforcement, strengthen the legal supervision of procuratorial organs, strengthen the supervision of the National People's Congress, the democratic supervision of the Chinese People's Political Consultative Conference, the supervision of the masses and public opinion, and strengthen the supervision of disciplinary inspection and supervision organs; Strengthen the guarantee of execution coordination work, clarify measures such as strengthening overall coordination, enhancing digital empowerment, strengthening team building, strict assessment and evaluation, and strengthening comprehensive protection. It is reported that in recent years, the procuratorial organs and law enforcement judicial organs in Beijing have implemented a comprehensive plan for governing the city in accordance with the law, focusing on improving the standards and procedures for case transfer, and actively exploring the establishment of a criminal execution linkage mechanism that reflects the capital's awareness, first good standards, and characteristics, forming many vivid practices. Next, the Beijing procuratorial organs will organize research and propose a "prosecutorial action" plan to implement the "Opinions", promote the "two-way flow" of execution linkage, prevent cases from being moved and punishment replacing punishment, and prevent only punishment without punishment, continue to promote the reverse linkage of execution as a new growth point in the development of administrative prosecutorial work, help build a rigorous legal supervision system, and contribute prosecutorial strength to the construction of China's prime area of rule of law.
