The Emergency Management Department will urge all regions to highlight "three types of places" and high-rise residential buildings, comprehensively and thoroughly investigate and rectify various fire safety risks and hidden dangers, and concentrate on addressing prominent issues such as electric bicycles entering buildings and households. Prosecutors in various regions are also looking back at public interest litigation cases that have previously urged the rectification of issues such as "flying wire charging" and illegal modification of electric bicycles. From the issuance of the "Notice on Carrying out Comprehensive Management of Fire Safety for Electric Bicycles" by the Office of the State Council Work Safety Committee in May 2018, to the joint issuance of the "Opinions on Strengthening the Implementation Supervision of National Standards for Electric Bicycles" by the State Administration for Market Regulation, the Ministry of Industry and Information Technology, and the Ministry of Public Security in March 2019, and to the joint issuance of the "Notice on Further Strengthening Fire Safety Management for Electric Bicycles" by the Ministry of Emergency Management, the Ministry of Industry and Information Technology, the Ministry of Public Security, the Ministry of Housing and Urban Rural Development, and the State Administration for Market Regulation in September of the same year, until the current centralized management, relevant special rectification and joint actions have been continuous and continuous. However, facing the growing variety and quantity of electric bicycles, aging circuits and batteries, and the widespread demand for illegal modification in the market, there is an urgent need to promote traceability governance through legal thinking and methods, especially through more powerful and effective institutional innovation. 1、 Optimizing top-level design and striving for product quality laws to strengthen legal supervision measures on the quality and safety of electric bicycle products. Prohibiting the production and sale of unqualified electric bicycle and battery accessories is the key to source control. The Product Quality Law has been included in the legislative planning of the 14th National People's Congress Standing Committee as a category one legislative project. The draft for public solicitation of opinions on the Product Quality Law released by the State Administration for Market Regulation on October 18, 2023 intends to stipulate in Article 81 that "for acts that violate the provisions of this Law and infringe upon the legitimate rights and interests of numerous consumers, people's procuratorates, consumer organizations, etc. may file civil public interest lawsuits with the people's court.". Based on the precedent of adding prosecutorial public interest litigation clauses in the Safety Production Law and the Agricultural Product Quality and Safety Law, procuratorial organs can comply with legislative guidance, actively and prudently handle prosecutorial public interest litigation cases in the field of electric bicycle product quality and safety, and accumulate practical experience and typical cases for legislative improvement. Firstly, we urge departments such as collaborative market supervision, industry and information technology, and public security to strengthen their supervision of the implementation of national standards for electric bicycles. Especially, we urge enterprises to strictly comply with the mandatory national standards in the "Safety Technical Requirements for Chargers for Electric Bicycles" implemented from July 1, 2023 and the "Electrical Safety Requirements for Electric Bicycles" implemented from January 1, 2024, strengthen the management of mandatory product certification for electric bicycles, strictly investigate and deal with unlicensed production, production beyond the scope of mandatory product certification, and reduced standard production, severely crack down on illegal production of counterfeit and inferior products, and effectively improve the essential fire safety level of electric bicycles. Secondly, urge departments such as collaborative market supervision to strengthen their supervision of the market
