2024-02-26
On February 23rd, the Supreme People's Court held a press conference to introduce the implementation of the "three regulations" on preventing interference in the judiciary by the people's courts. The "Three Regulations" are important institutional designs for deepening the comprehensive rule of law in China. They refer to the "Regulations on the Record, Notification, and Accountability of Leading Cadres' Intervention in Judicial Activities and Intervention in Specific Cases" issued by the General Office of the Communist Party of China and the State Council, the "Regulations on the Record, Notification, and Accountability of Personnel Intervening Cases within Judicial Organs" issued by the Central Political and Legal Affairs Commission, and the Supreme People's Court, the Supreme People's Procuratorate, the Ministry of Public Security, and the Ministry of National Security The Ministry of Justice jointly issued several regulations on further regulating the contact and communication behavior between judicial personnel and parties, lawyers, special relationship persons, and intermediary organizations. In 2023, the leaders of the Supreme People's Court recorded 129 pieces of report information, and department heads recorded 1022 pieces of report information. Under the strong promotion and demonstration of the Supreme People's Court, the implementation of the "Three Provisions" by courts across the country has been deeply and solidly promoted, and the number of police officers recording and reporting personnel and information has been increasing year by year. In 2023, more than 1.2115 million police officers and more than 1.9385 million reported information were recorded in national courts, an increase of 7.5 times and 11.8 times respectively compared to 2022. From the content of the recorded report information, the vast majority are for supervising the work of the court, and a very small number are for illegally intervening in interrogation cases. Gao Bo, Deputy Leader of the Discipline Inspection and Supervision Group of the Central Commission for Discipline Inspection and the National Supervisory Commission stationed at the Supreme People's Court, introduced that currently, the overall situation of the court system's implementation of the "Three Regulations" continues to improve. In 2023, 213200 pieces of information were filled out by "leaders" and team members of courts at all levels nationwide, and 582300 pieces of information were filled out by judges. The two items together account for 41.04% of the total filling out, driving the court system to basically achieve full coverage of the "Three Regulations" filling out. However, some judges and police officers have not deeply realized that the "three regulations" are not only serious political discipline, but also a safety net for the career of judges in the new era. Strictly adhering to the "three regulations" requires long-term efforts and continuous efforts. The Supreme People's Court supervises and guides courts in various regions to strengthen regular inspection and supervision through measures such as judicial patrols, judicial supervision, and special inspections. It adopts methods such as criticism and reminders, sending letters to supervise, and interviewing unit leaders to supervise and rectify problems, and conscientiously rectify prominent problems such as "not filling in truthfully", "filling in with numbers", and "filling in with caution". In 2023, more than 2500 court officers involved in violating the "three regulations" were held accountable through the use of the "four forms" of supervision and discipline. Among them, 723 officers were held accountable for not recording and reporting truthfully through investigations of disciplinary and illegal cases, forming a warning and educational effect of "one accountability, one warning". From the information recorded and reported by the police, it can be seen that the vast majority of people, representatives of the National People's Congress, members of the Chinese People's Political Consultative Conference, and leading cadres who inquire or inquire about a specific case are appealing to explain the relevant situation and hoping that the court will try the case as soon as possible. The essence is to supervise and promote the court to further achieve fair and efficient trial of the case. Liao Xiangyang, Director of the Supervision Bureau of the Supreme People's Court, stated that the people's court sincerely accepts supervision, truthfully records it, and handles it in accordance with the prescribed procedures in accordance with the law. By speeding and relentlessly grasping the "three"
