Safeguard the safety of the people's tongues
2023-12-06
Recently, the Supreme People's Court and the Supreme People's Procuratorate jointly released a batch of typical cases of food safety crimes during the "National Food Safety Propaganda Week" event held with various member units of the State Council Food Safety Committee. Two of these cases involved defendants using online channels to sell counterfeit and inferior food as well as toxic and harmful food, which attracted widespread social attention. Nowadays, it is not new for consumers to purchase food from e-commerce platforms or live streaming rooms. However, while online channels enrich consumer shopping choices, they also conceal many risks. For example, in the two cases mentioned above, after producing and selling fake and inferior beef and toxic and harmful weight loss foods, criminals sold them to various parts of the country through e-commerce channels in a large-scale, organized, and chain based manner, seriously infringing on the legitimate rights and interests of consumers. The reason why criminals target online channels is, on the one hand, because online shopping lacks intuitiveness, and consumers cannot feel the quality, taste, and other aspects of the product up close, which can easily give criminals an opportunity to engage in false advertising; On the other hand, due to the large number of e-commerce platforms, criminals can easily evade supervision by being able to switch places with one shot. From the relevant cases released this time, it can be seen that the judicial authorities have actively fulfilled their duties, comprehensively used methods such as sorting out electronic data, digging deep into logistics and transfer records, and locked in clues to the production and sale of toxic and harmful food. They have also formed a "full coverage" crackdown on the criminal chain, not only clarifying that food safety is an unchallengeable "bottom line", It also demonstrates the determination of the judicial authorities to "always be on the road" in combating food safety crimes. The food safety work chain is long, with each link being linked together, and all parties involved in each link should take on their own responsibilities. Regulatory authorities should establish and improve dynamic regulatory mechanisms, continuously improve the accuracy and effectiveness of supervision, in order to respond to various new situations and problems in food safety work. Platform enterprises should take on the main responsibility and strengthen the qualification review and control of merchants entering the platform; At the same time, platforms should promote the establishment of a "blacklist" sharing mechanism to prevent illegal elements from "changing their appearance" and continuing to commit evil. Consumers should also promptly preserve evidence when facing fraud, file complaints in accordance with the law, and protect their legitimate rights and interests through legal means. Only in this way can we jointly maintain the order of the online shopping market and safeguard the safety of the tongue. (Lai Xin She)
