Primary school students use their parents' mobile phones to recharge games. Can the recharge money be refunded?

With the popularization of the Internet, minors' online "reward" and recharge behaviors have occurred from time to time. Can the payments made by minors during the process of participating in online paid games, such as recharging and "rewards," be recovered if they are not suitable for their age and intelligence? Recently, the Guangzhou Internet Court released such a case. Case review: Shen was a pupil under 11 years old. Without his parents' knowledge, he used his father's mobile phone number to register an account in an online game operated by a game company, and used his father's Alipay to recharge frequently. The total recharge was 30000 yuan, with a record of 648 yuan for a single recharge. Shen's guardian believes that as a primary school student, Shen's recharge amount and consumption behavior have exceeded his civil capacity and should not be effective. Therefore, he sued the court and requested the game platform to return the recharge money. The court believes that Shen's high-value recharge behavior as a minor is not compatible with his identity, age, and economic status. During the trial, the court found that the real name authentication of game platform accounts was virtually non-existent and violated the national requirements to prevent minors from becoming addicted to online games. After mediation by the Guangzhou Internet Court, the game company refunded a one-time recharge of 30000 yuan to Shen. At the same time, the Guangzhou Internet Court also issued a judicial recommendation to game companies, recommending that game companies strictly implement the real name authentication registration system, standardize online game services, and effectively curb minors' addiction to games, excessive consumption, and other negative behaviors. According to the case, minors are addicted to online games and live streaming, and irrational high recharge and "rewards" beyond their age and intelligence need to be highly valued. This case issues a judicial recommendation to the game company regarding the issues discovered during the trial, promoting the game platform to fulfill its legal obligations, strengthening social responsibility, and providing a healthy and beneficial online environment for the public.
