Providing heartwarming judicial services for the elderly population
2023-10-23
The Opinions of the Central Committee of the Communist Party of China and the State Council on Strengthening the Work on Aging in the New Era propose to strengthen the protection of the rights and interests of the elderly, and enhance their sense of gain, happiness, and security. It is the duty of the people's court to provide strong judicial protection and services for the elderly to live a dignified, valuable, and high-quality life in their later years. With the increasing number of cases involving the elderly and the increasing diversity of case types, we are exploring the construction of a comprehensive aging litigation mechanism to ensure that the elderly enjoy inclusive and equal judicial services, making fairness and justice more accessible, and becoming the answer sheet that people's courts should hand over in response to the needs of the times. In the context of building an elderly friendly society, it is necessary and urgent to introduce a suitable litigation mechanism to ensure the full participation of the elderly in litigation and safeguard their legitimate rights and interests. Exploring innovative mechanisms for aging litigation, assisting elderly people with weak litigation capacity to participate in litigation, arranging pre-trial counseling, introducing family and friends to accompany litigation, expanding the scope of legal aid, and obtaining support from grassroots organizations. Given the generally weak ability of elderly people to provide evidence, judges should also be required to investigate facts more ex officio. Regarding issues that may have a significant impact on elderly people who are difficult to understand, hesitant to make decisions, and frequently repeat, judges will provide prompts, explanations, feedback, and corrections to ensure that the elderly fully understand. Exploring the establishment of a judicial service mechanism that benefits the elderly. Configure a special area for elderly litigation services to provide convenience for the elderly to participate in litigation activities. Establish a working mechanism of "door-to-door acceptance, door-to-door conversation, door-to-door court hearing, door-to-door execution, and door-to-door follow-up" for disabled elderly people, integrating humanized, refined, and specialized judicial care concepts into the entire process and aspects of law enforcement and case handling. Explore the extension of the aging litigation service chain, and extend judicial care for the elderly from within the court to outside the court. Improve the governance of litigation sources, further improve the linkage and resolution system for conflicts and disputes involving the elderly, and establish a friendly litigation service mechanism for the elderly. Focusing on the key issues and precise legal education, targeting marriage and family, support disputes, labor disputes and other cases closely related to the lives of the elderly, with the needs of the elderly as the guide, we will increase legal education efforts and effectively promote the dissemination of relevant legal and regulatory knowledge.
