What kind of off campus training will be penalized? How to punish? Who will punish? Regarding these issues of concern to the public, the measures are formulated one by one, aiming to strengthen the supervision of off campus training and make it a beneficial supplement to school education. The person in charge of the Supervision Department of Off campus Education and Training of the Ministry of Education, which is deepening the governance of off campus training through the rule of law, stated that since the implementation of the "double reduction" reform for two years, the governance of off campus training has achieved phased results. However, problems such as unauthorized establishment of off campus training institutions and covert variation of off campus training still exist to varying degrees, and some institutions still have sporadic issues of "payment evasion", and the legitimate rights and interests of the people are still being damaged from time to time, There is an urgent need to improve the legal system for off campus training, clarify law enforcement responsibilities, authority, and basis, enhance the standardization and legalization of off campus training law enforcement, make violators pay the price, protect compliant individuals, and ensure the continuous effectiveness of the "double reduction" reform. At the same time, various sectors of society generally call for the introduction of administrative punishment measures in the field of off campus training as soon as possible, to strengthen and standardize the administrative punishment work of off campus training, and to deepen the governance of off campus training through the rule of law. How to Punish Unauthorized Organizing Off campus Training Institutions (Private Schools) is an illegal act prohibited by the Private Education Promotion Law. Article 17 of the Measures specifies the circumstances for determining the unauthorized establishment of off campus training institutions, and stipulates that natural persons, legal persons, or other organizations who conduct off campus training without approval, and who meet the requirements of having specialized training venues for offline training or specific websites or applications for online training, having two or more training practitioners, corresponding organizational structures, and division of labor, shall constitute unauthorized establishment of off campus training institutions. Order the suspension of the event, refund of the fees collected, and impose a fine of not less than one time but not more than five times the illegal gains on the organizer. Article 18 of the Measures clarifies the situation of unauthorized and paid training for hidden variations in disciplines: - "online transfer": paid off campus training conducted through instant messaging, online conferences, live streaming platforms, and other means; ——Transfer to underground ": utilizing residential buildings, hotels, coffee shops, and other venues to organize off campus training such as" one-on-one "and" one-to-many "; ——Exchange of vests ": Paid off campus training conducted in the name of consultation, cultural dissemination, quality expansion, competition, thinking training, home service, family education guidance, home teachers, crowdfunding private teaching, study tours, research, winter and summer camps, trusteeship, etc. These behaviors will be subject to warnings and fines of up to 100000 yuan. In addition, off campus training institutions will also be punished for the following violations: - If the training content violates laws and regulations and relevant regulations of the State Council's off campus training authority, and affects the physical and mental health of minors, a heavier punishment will be imposed; ——If the appointment and management of employees of off campus training institutions violate laws, regulations, and relevant regulations of the competent department of off campus training under the State Council, they shall be ordered to make corrections within a specified period of time, and their illegal gains shall be confiscated after returning the fees collected. If the circumstances are serious, they shall be ordered to stop recruiting students and revoke their licenses. ——The pre charge management of off campus training institutions violates laws and regulations and relevant departments of the State Council
