2023-08-28
The Supreme People's Court and the Supreme People's Procuratorate have jointly released a batch of typical cases of ecological environment protection procuratorial public interest litigation, including 10 cases of administrative public interest litigation filed by the Yijiang District Procuratorate of Wuhu City in Anhui Province against the Agricultural and Rural Bureau of Wuhu City, covering areas such as watershed protection, grassland resource protection, forest resource protection, solid waste pollution, and water pollution prevention and control. It is reported that the cases released this time are all prosecution cases, aiming to guide the procuratorial organs to balance "public welfare" and "litigation" in handling cases. In response to inadequate rectification, they are brave and adept at using legal means to initiate litigation to strengthen supervision effectiveness, efficiently stop illegal activities, repair damaged public welfare, solve problems in the form of "litigation", promote the governance of similar cases and litigation sources, and promote social progress. The case also reflects that the judicial organs fully play the role of intermediary judgment and play a judicial role in public welfare protection. The relevant officials of the Supreme Court of Environmental Resources and the Eighth Procuratorate of the Supreme People's Procuratorate stated that the national judicial and procuratorial organs should further increase their efforts in handling cases and strive to find the best solution for ecological protection and restoration.
