Standardize facial recognition applications to protect personal information security

Recently, the National Cyberspace Administration of China released the "Regulations on the Safety Management of Facial Recognition Technology Applications (Trial) (Draft for Soliciting Opinions)" to solicit opinions from the public. The solicitation draft proposes that facial recognition technology can only be used to process facial information when it has a specific purpose and sufficient necessity, and strict protective measures are taken. In recent years, facial recognition technology has made continuous breakthroughs and has been widely used due to its efficiency and convenience, becoming an effective technological means to promote the development of the digital economy and social governance. However, the personal information security issues brought about by this have also become increasingly prominent. For example, some stores collect and analyze consumer facial information without consent, and then adopt different marketing strategies; Some property service companies force facial recognition as the only verification method for homeowners entering and exiting the community; Some online platforms and applications force users to obtain facial information. Therefore, due to the leakage of identity information such as facial information, problems such as "being scammed" and infringement of privacy and reputation rights often occur, threatening the safety of people's personal and property, and disrupting social order. Nowadays, we need to promote the use of facial recognition technology in application scenarios to benefit users, ensure continuous innovation and progress, and also prioritize security, especially to prevent technology abuse, and strive to minimize potential risks that may arise. Our Civil Code stipulates that the personal information of natural persons is protected by law, and biometric information is listed as personal information. The Personal Information Protection Law classifies biometric and other information as sensitive personal information and provides special protection. The Supreme People's Court has issued the "Provisions on Several Issues Concerning the Application of Law in the Trial of Civil Cases Related to the Use of Face Recognition Technology to Process Personal Information", clarifying how to identify and handle relevant cases. This solicitation draft not only responds to the hot issues of "mandatory facial brushing into residential areas" that the public is concerned about, but also further clarifies that facial recognition technology is not necessary and should not be used to prevent its abuse. Face recognition technology is not only about technological innovation, but also about information security. By taking multiple measures and achieving long-term success, we can weave a dense personal information security protection network and jointly build a good digital ecosystem for governance and sharing. Law enforcement and judicial departments should increase their supervision and crackdown efforts, and promptly punish illegal activities such as misuse of facial recognition technology and personal information trading. For enterprises and online trading platforms, they should adhere to the principles of "legality, legitimacy, and necessity" in collecting and processing user information, strengthen self-discipline, and abide by the legal red line. The general public should also enhance their awareness of personal information protection, adhere to the principle of "not providing unnecessary information" for personal information collection and permission requests, and be brave enough to take up legal weapons to safeguard their legitimate rights and interests. I believe that with the continuous tightening of the rule of law network, the application of facial recognition technology will become more standardized, and the internet industry will also develop in a higher quality and healthier manner, achieving a value balance between technological development and rights protection, and achieving a positive interaction between technological applications, business ethics, and social values, allowing people to embrace and enjoy digital life with peace of mind.
