In July 2020, the Supreme People's Procuratorate deployed a three-year special supervision activity on "safeguarding a better life through public interest litigation" to procuratorial organs nationwide. It is understood that the proportion of public interest litigation cases in the fields of ecological environment and resource protection to the total number of public interest litigation cases has always been maintained at around 50%. In the past three years, there have been some changes in the handling of public interest litigation cases in the field of ecological environment and resource protection by procuratorial organs. Faced with the constantly evolving situation of handling cases, how can procuratorial organs adjust their work strategies and methods? Hu Weilie, Director of the Eighth Procuratorate of the Supreme People's Procuratorate, introduced that in the past three years of carrying out special supervision activities, the procuratorial organs have handled public interest litigation cases in the fields of ecological environment and resource protection. The main change lies in the shift from the goal of repairing damaged ecosystems to the concept of actively performing duties in accordance with the law and promoting litigation source governance. In addition to traditional environmental factors such as atmosphere, water, and soil, it also involves forest diseases and pests, rare birds, endangered plants, wetlands, nature reserves, cultural relics, and natural relics, presenting diverse characteristics. In the past three years, the quality and efficiency of handling public interest litigation cases have been continuously improved, and the procuratorial organs have successfully handled a large number of influential cases such as the "Wanfeng Lake Case" and the "Nansi Lake Case". From handling individual cases to supervising similar cases, thereby promoting the governance of litigation sources and systems. In addition, we will explore the punitive compensation system for ecological environment infringement, continuously enrich the use of carbon sequestration as a substitute for restorative judicial methods such as ecological environment restoration, and develop a big data legal supervision model to empower environmental resource prosecution and case handling. Ecological environment and resource protection are one of the "four legal fields" initially established in the public interest litigation and prosecution system, and the damaged social public interests in this field often have characteristics that cross regions and departments. Cross regional and cross departmental collaborative protection is an essential issue in the field of ecological environment and resource protection, and also a difficult point that cannot be avoided.
