On the 15th, the Supreme People's Court issued the "Interpretation on Several Issues Concerning the Application of Law in the Trial of Ecological Environment Tort Liability Disputes" (hereinafter referred to as the "Interpretation"), which takes the realization and protection of the people's ecological environment rights and interests as the starting point and foothold of ecological environment trial work, and makes systematic provisions on the application of law in ecological environment infringement. The Interpretation stipulates that ecological environment infringement cases include environmental pollution liability disputes and ecological damage liability disputes, reasonably determining the scope of ecological environment infringement cases, and clarifying that environmental pollution includes material pollution such as wastewater, exhaust gas, medical waste, dust, foul gases, as well as energy pollution such as noise, vibration, and light radiation; Ecological damage includes ecological damage caused by unreasonable development and utilization of natural resources such as illegal mining and deforestation, as well as ecological damage caused by illegal introduction, release, and disposal of foreign species. According to the Interpretation, if the claimant claims that the perpetrator is responsible for polluting the environment, damaging the ecology, affecting others' daily lives such as water intake, fishing, hunting, and gathering, and causing economic losses, and meets the following circumstances, the people's court shall support the claim: the claimant's activities are located in or near the ecological environment damaged area; The requester's activities rely on the damaged ecological environment; The requester's activities are not fungible or the cost of substitution is too high; The activities of the requester are stable and open. In addition, if the requester's activities require permission from relevant administrative authorities in accordance with national regulations, they should also obtain permission in accordance with the law.
