Recently, the reporter learned from the Supreme People's Procuratorate that from April to December this year, the Supreme People's Procuratorate, in conjunction with the Ministry of Public Security and the Ministry of Ecology and Environment (hereinafter referred to as the "three departments"), continued to carry out a special action nationwide to crack down on illegal activities related to hazardous waste and environmental pollution, as well as the automatic monitoring data falsification and illegal activities of key pollutant discharge units (hereinafter referred to as the "special action"). This is the fourth consecutive year for the three departments to carry out the "two strikes" special action nationwide. It is reported that before the launch of this special action, the three departments jointly issued the "Notice on Deepening the Crackdown on Hazardous Waste Environmental Illegal Crimes and Key Pollutant Discharge Units' Automatic Monitoring Data Falsification and Illegal Crimes" (hereinafter referred to as the "Notice"), making comprehensive arrangements for the work objectives, key points, tasks, and requirements of the special action. The Notice points out that we must adhere to precise pollution control, scientific pollution control, and legal pollution control, and strictly crack down on illegal discharge, dumping, collection, storage, transfer, utilization, and disposal of hazardous waste, as well as falsification of automatic monitoring data of pollutant emissions by key pollutant discharge units and other environmental violations and crimes in accordance with the law. We need to use digital means such as big data, the Internet, and the Internet of Things to enhance our ability to discover, analyze, trace, investigate, and accurately crack down on illegal and criminal clues, strengthen joint law enforcement, escalate investigations, and list supervision of key cases such as cross administrative regions, and improve our ability and level of handling cases. The Notice specifies three key areas of work. One is to focus on cracking down on illegal and criminal activities related to hazardous waste environment. Pay close attention to hazardous waste such as waste mineral oil and mineral oil containing waste, non-ferrous metal mining and smelting waste, waste acid, waste lead batteries, and closely monitor the trend of hazardous waste transfer across regions and to rural areas. The second is to severely crack down on the illegal and fraudulent behavior of automatic monitoring data. Strictly investigate illegal activities of abnormal operation of automatic monitoring equipment; Focus on cracking down on environmental illegal and criminal activities such as tampering, forging automatic monitoring data, or interfering with automatic monitoring facilities; Emphasis will be placed on cracking down on the crimes of automatic monitoring data falsification, such as modifying the range, intentionally miscalibrating, replacing water samples or artificially using reagents, interfering with the environmental conditions and operating status of instruments with standard samples, as well as using virtual software, installing resistors, and other specialized falsification behaviors. The third is to carry out case "looking back". Led by various ecological and environmental departments, with the cooperation of procuratorial and public security organs, we will carry out a "look back" on cases of illegal environmental crimes involving hazardous waste transferred since 2020 and cases of automatic monitoring data falsification and illegal crimes committed by key pollutant discharge units. We will track and understand the progress of case handling, transfer, criminal filing, investigation, review, prosecution, prosecution, and court judgments, and improve the system for linking execution, Further guide the handling of environmental violations and crimes. In addition, the Notice also proposes three tasks, including strengthening technical support and expanding channels for discovering illegal and criminal clues; Strengthen the linkage between law enforcement and justice, and consolidate the joint efforts in cracking down on illegal and criminal activities; Improve the case handling mechanism and enhance the level of handling illegal and criminal cases. The Notice requires all three departments in different regions to strengthen organizational leadership, strengthen overall coordination, formulate and refine work plans based on actual situations such as industrial structure, industrial clusters, and industrial characteristics, highlight key points, and widely mobilize and deploy; Establish and improve information communication and sharing mechanisms, and jointly promote the resolution of key and difficult issues
