Empowering legal supervision with big data thinking is a skill that prosecutors must master in the new era. At the beginning of 2022, our court launched the "Big Data Empowerment to Assist in the High Quality Development of Public Interest Litigation" project to address issues such as difficulty in discovering clues, information asymmetry among various business departments, and unclear quality and efficiency of integrated prosecution cases. The "Luojiayun" platform emerged as the times require. Frontline case handling prosecutors set keywords in the field of public interest litigation prosecution based on past case handling logic and experience, and capture data sources from the information provided by the procuratorial business application system and the internet to build a data warehouse. When the "Luojianyun" platform is launched, the constructed supervision model will automatically collide and compare the extracted information, and the final presentation on the platform is the list of clues generated by the prosecutor based on the likelihood of filing, effectively improving the filing rate of public interest litigation cases. In May 2022, when the prosecutor in charge of public interest litigation in our court logged into the "Luojianyun" platform to view, a clue in the field of cultural relics protection was displayed in front of him. The platform compared and analyzed keywords such as "reselling cultural relics", "damaging cultural relics", and "restoring cultural relics", and found that there were public interest litigation clues in a case of reselling cultural relics that our criminal prosecution department is currently reviewing and handling, which has filing value. After investigation, the suspect has carried out chemical reagent rust removal, machine polishing and polishing, welding with the same material and other acts on more than 30 precious cultural relics, including the Tang Dynasty sea animal grape mirror (national first-class bronze mirror cultural relics), in the process of reselling cultural relics, which has caused irreversible damage to the cultural relics, and should be subject to a civil public welfare lawsuit attached to criminal proceedings. Our two departments have worked closely together to conduct multiple discussions on key issues such as factual determination and cultural relic damage determination. In response to professional issues such as the appraisal of the value of cultural relic damage in the case, we have invited cultural relic experts from Luoyang Municipal Cultural Relics Bureau, Luoyang Municipal Museum, and other units to conduct technical analysis and provide opinions on cultural relic damage assessment. Based on this, we have initiated a criminal civil public interest lawsuit. Luoyang is a national historical and cultural city. This case is not only the first case of criminal incidental civil public interest litigation for the protection of movable cultural relics in our city, but also the case with the highest number of people seized and cultural relics recovered within the city. We will report the loopholes in cultural relics supervision discovered during the handling of the case to the Luoyang Municipal Procuratorate. The Luoyang Municipal Procuratorate will urge the municipal cultural relics management department to carry out special rectification of the city's cultural relics trading venues. For areas with a large number of ancient tombs such as Mangshan, we will promote county-level cultural tourism and public security departments to strengthen joint prevention and control. Village and community organizations will select specialized personnel to serve as cultural relics protectors, and establish special contacts with district level public security organs (police stations), Open up the path of cultural relics protection that can be reported and dealt with in a timely manner in case of theft and excavation, and form an effective joint force for comprehensive management. Since the launch of the "Luojianyun" platform, our court has pushed over 100 public interest litigation leads and filed 26 cases through this platform, achieving significant results in the public interest litigation prosecution work of the entire court. In order to achieve more "extended learning" while handling cases, we continuously improve the effectiveness of the "Luojianyun" platform.
