With the development of the internet age, new types of illegal and criminal methods have emerged one after another, and elderly people who were supposed to take care of themselves and enjoy the happiness of their family have also become the targets of criminals. Criminals take advantage of the weak points of some elderly people, such as low educational level, limited information contact, and poor awareness of fraud prevention, to commit fraud against them in fields such as elderly care, investment, and healthcare, seriously infringing on their property rights and physical and mental health. Our hospital has handled such a case before. From November 2019 to June 2020, Xue successively established an e-commerce shopping platform in Hebei and Henan provinces, hired 5 customer service and warehouse management personnel, and organized pyramid schemes nationwide. The prices of the products on this platform are much higher than normal prices by several times, or even dozens of times. So, in what form do they attract buyers? After investigation, the police found that the pyramid scheme used gimmicks such as "buying goods and giving equity" and "supporting domestic products" to falsely claim that after the platform company goes public in the future, it will receive huge returns, luring elderly people to purchase goods at high prices and charging "entry fees" in disguised form, encouraging elderly people to develop offline and giving them rebates based on the number of people who develop offline. Playing emotional cards, drawing big cakes, Xu Xiaoli, and pulling people's heads... In just 8 months, the MLM organization has developed over 10000 members, absorbed over 11 million yuan of MLM funds, and illegally profited over 1.8 million yuan. Due to the large number of people involved in this case and its wide coverage, it is a serious challenge for investigators to investigate the case and form a complete evidence chain within a limited time. Therefore, at the beginning of the case investigation, our court dispatched prosecutors to intervene in the case in advance, guiding the investigation authorities to focus on analyzing the website promotion, backend data, customer service chat records, and fund flow of the e-commerce platform, laying the foundation for the investigation authorities to clarify the direction of the case and clarify the key points of evidence collection. In order to further investigate the facts of the case, the prosecutor has repeatedly explained the law and reasoning to five customer service and warehouse management personnel on the e-commerce platform, introducing them to the lenient system of confession and punishment. In the end, all five people pleaded guilty and punished. After clarifying the case, how can we recover the stolen money? In the early stages of handling the case, the investigation authorities only had access to some of the payment channels of the pyramid scheme platform, and only discovered that the involved gang had collected over 1 million yuan of pyramid scheme funds. Through guiding the investigation organ to dig deeply and thoroughly, we finally found that Xue and others collected 10 million yuan of pyramid selling funds through their Alipay account. At the same time, we also found out the flow of other funds involved in the case, freezing the illegal profits of more than 1 million yuan of Xue and others. In October 2021, after our court filed a public prosecution, the court sentenced the defendant Xue to ten years in prison and a fine of 300000 yuan for organizing and leading pyramid schemes. Five customer service and warehouse management personnel voluntarily pleaded guilty and were sentenced to four years and two months to one year and two months in prison by the court, each with a fine. The court ordered the defendant to return the remaining illegally obtained funds and confiscated the illegal profits of over 1 million yuan.
