Provide strong legal protection for safeguarding the legitimate rights and interests of the elderly

Punitive compensation liability should be borne for consumer fraud among the elderly, and breach of contract liability should be borne in accordance with the law for failure to provide elderly care and health care services as agreed. Recently, the Supreme People's Court released a batch of typical cases of protecting the rights and interests of the elderly, which has attracted social attention. The aging population is the fundamental national condition of China for a considerable period of time in the future. Promoting the high-quality development of aging work in the new era and ensuring the legitimate rights and interests of the elderly are not only related to their sense of gain, happiness, and security, but also to the overall situation of social stability and national development. Revise the Law on the Protection of the Rights and Interests of the Elderly, and add provisions related to the elderly in the Civil Code and specialized laws in areas such as basic medical care, public health, and public culture... Since the 18th National Congress of the Communist Party of China, the institutional system for safeguarding the legitimate rights and interests of the elderly has been continuously strengthened. The relevant departments have further introduced policy measures, management norms, and technical standards for medical services, rehabilitation care, and accessible environment construction for the elderly, effectively ensuring the quality of elderly care services. Last year, political and legal authorities organized a special campaign to crack down on elderly fraud, striving to create a good social environment for the elderly to enjoy a happy old age. Practice has proven that the more targeted the construction of the rule of law is, the stronger the protection of the legitimate rights and interests of the elderly. In recent years, with the rapid development of the economy and society, the elderly have put forward more diverse needs in areas such as healthy elderly care, property disposal, and emotional comfort. At the same time, there have been some new trends in infringing on the legitimate rights and interests of the elderly. These new demands and trends are the focus of legal construction. For example, as more and more elderly people are exposed to financial and wealth management products, how can we ensure the safety of their financial consumption? How to protect the legitimate property rights and interests of the elderly, as there are frequent cases of using "housing for elderly care" as a pretext to defraud them of money? What kind of care obligations should elderly people fulfill when living in elderly care institutions? Faced with new situations, there must be new methods. The typical cases released by the Supreme Law this time involve protection of residential rights, entrusted financial management, elderly care through housing, spiritual support, obligations of elderly care institutions, tourism rights protection, etc., which basically cover the main new issues of elderly care in current society. The centralized release of these cases not only provides strong guidance for the execution of elderly related trials in the future, but also provides effective risk warnings for the majority of elderly people. Ensuring the legitimate rights and interests of the elderly requires perseverance and long-term efforts. We must always keep a close eye on new issues related to the elderly care industry and consumer fraud, increase law enforcement and judicial efforts, deepen reform and innovation, establish and improve early warning, investigation, and mediation mechanisms for conflicts and disputes related to marriage, family, and infringement among the elderly, promote the resolution of the source of conflicts and disputes involving the elderly, establish a suitable litigation service mechanism, and better meet the judicial needs of the elderly. In addition, relevant departments should further strengthen the publicity and education of the rule of law, guide the elderly to learn legal knowledge, enhance their awareness of the rule of law, and learn to use legal weapons to protect their legitimate rights and interests. Only by deeply cherishing respect for the elderly, pouring in love for them, taking active actions, and truly working hard, can the rule of law better safeguard the legitimate rights and interests of the elderly.
