It is found that Kingston Technology Co., Ltd. has obtained the license to use the two registered trademarks "KINGSTON" and the illustration (Figure 1) according to the authorization, and has the right to file a lawsuit in its own name against the infringement of the license to use the two registered trademarks. It is confirmed that the sued infringing USB flash disk and the goods approved for use by the registered trademark involved are the same or similar goods. Wengyuan Court held that the defendant sold the sued infringing USB flash disk without the plaintiff's permission, and used goods with the same or similar logo as the plaintiff's registered trademark on the same or similar goods, which is easy to cause confusion. The defendant's sales behavior has constituted an infringement of the plaintiff's registered trademark exclusive right, and should bear the corresponding civil infringement liability. Therefore, the defendant was judged to immediately stop selling the goods infringing the plaintiff's registered trademark exclusive right, And compensate for the corresponding losses. The judge reminded that in the past two years, various trademark infringement cases have increased year by year.
