2023-01-12
On January 1 this year, the revised Law of the People's Republic of China on the Protection of Women's Rights and Interests came into force. Article 29 of the Law stipulates that it is prohibited to pester and harass women, disclose and disseminate women's privacy and personal information on the grounds of love and friendship or after the termination of love and divorce; Women who have suffered from the above-mentioned violations or are in real danger of the above-mentioned violations may apply to the people's court for a personal safety protection order. On January 10, the People's Court of Yuelu District, Changsha City, Hunan Province, issued the province's first personal security protection order to protect the rights and interests of women's privacy and personal information, ruling to prohibit the respondent Zhang from pestering and harassing the applicant Wang and disclosing and disseminating Wang's privacy and personal information. Zhang and Wang were originally lovers. In 2022, the two ended their love relationship. After that, Zhang repeatedly pestered and harassed Wang through text messages, phone calls and social software, and sent his private photos to others. Wang Moumou believes that Zhang Moumou's behavior has caused double physical and psychological trauma and extremely bad social impact, and applies to Yuelu District Court for a personal safety protection order. After examination, the court found that Wang's application was in conformity with the relevant provisions of the Law of the People's Republic of China on the Protection of Women's Rights and Interests and the Law of the People's Republic of China on the Prevention of Domestic Violence, and made the aforementioned personal safety protection order after accepting the application. Wang Xiang, the case handling judge, said that the newly revised Law on the Protection of Women's Rights and Interests expanded the scope of application of the Personal Safety Protection Order in the Anti-Family Violence Law implemented in 2016, and provided a more powerful weapon to protect the rights of victims in marriage and love. Women who suffer from entanglement, harassment, disclosure, dissemination of privacy and personal information due to marriage disputes or face the real danger of the above-mentioned infringement may apply to the people's court for a personal safety protection order. It is understood that, as the first pilot court for the reform of family trial methods and working mechanism in China, Yuelu District Court has actively explored the issue and implementation of special procedures for family trial, especially the personal safety protection order, and has issued the first personal safety protection order in Hunan Province, the first personal safety protection order for men in China The first personal safety protection order applied for by the Women's Federation on behalf of the country and with a single independent case, and other personal safety protection orders with great influence in the province and even the country. Before the implementation of the newly revised Law on the Protection of Women's Rights and Interests, the Yuelu District Court also boldly explored and issued several personal safety protection orders for former spouses, which achieved good results and provided basic practical basis for relevant legislation.
