The defendant committed the crime of illegally purchasing or selling terrestrial wildlife and was sentenced to three months of criminal detention and six months of probation. Deng took the initiative to compensate 12460 yuan for the economic losses caused to the country. From September 2021 to January 2022, the defendant Deng has illegally purchased wild animals such as wild boars and muntjacs in Xingan County for a long time. During this period, he also purchased wild animals from the boss surnamed Tang in Le'an, Fuzhou for many times, and sold the purchased wild animals mainly to Yuan in Xiajiang County, then sold them to various hotels in Xinyu, or sold them sporadically to the surrounding people for food to earn the difference in price. On January 7, 2022, the police of Xingan County Public Security Bureau searched Deng's residence according to law, and found 1 wild boar head, 1 wild boar belly, 2 pieces of wild boar meat, 8 South China rabbits (hares), 2 muntjacs, 22 Chinese bamboo rats, and 1 king snake on the spot. In the taxi driven by Yi, the delivery driver for Deng, 2 boar heads, 2 strings of boar viscera, 2 pieces of boar meat and 4 boar feet were found on the spot. The Judicial Identification Center identified that the wild boar, Chinese bamboo rat, South China rabbit, small muntjac and king snake illegally purchased by Deng were all included in the List of Terrestrial Wild Animals with Important Ecological, Scientific and Social Values under National Protection. The total value of the above species is 12840 yuan. On January 7, 2022, the Public Security Bureau of Xingan County arrested the defendant Deng. After the crime, Mr. Deng truthfully confessed the facts of the crime and returned 50000 yuan of stolen money. On November 1, 2022, the People's Procuratorate of Xingan County filed a public prosecution to the court. In the process of litigation, the People's Procuratorate of Xingan County filed a civil public interest litigation incidental to criminal proceedings. The court of Xingan County formed a collegial panel and held a joint hearing in public on November 11, 2022. After the court hearing and cross examination, the court ruled on November 17, 2022 according to the law: Mr. Deng committed the crime of illegally purchasing and selling terrestrial wildlife, and was sentenced to three months of detention and six months of probation; Compensation for direct economic losses caused to the country by illegal purchase and sale of 34 wild animals is 12460 yuan.
