Recently, the Criminal Trial Division of the People's Court of Neixiang County, Henan Province publicly sentenced a case of helping information network criminal activities in accordance with the law. The defendant, Wang, committed the crime of helping information network criminal activities and was sentenced to two years of fixed-term imprisonment, two years of probation and a fine of 10000 yuan. The court found through trial that from February 2022 to July 2022, the defendant Wang, knowing that others were using the information network to commit crimes, took the form of sending and receiving red packets to attract attention with his recruiters in WeChat groups for the purpose of obtaining illegal interests, and helped criminal agents promote fraud related apps. The defendant Wang made illegal profits of more than 100000 yuan. In addition, it was found that the defendant Wang voluntarily turned in 120000 yuan of illegal income after arriving at the case, compensated the victim Liu 10000 yuan, and obtained Liu's understanding. After trial, the court held that the defendant Wang, knowing that others were using network information to commit crimes, provided help for criminals to promote fraudulent APP for the purpose of seeking illegal interests. The circumstances were serious, and his behavior had constituted the crime of helping information network criminal activities. The establishment of the charges and facts charged by the public prosecution organ shall be supported. In view of the fact that the defendant, Mr. Wang, truthfully confessed his crime after arriving at the case, voluntarily returned the stolen goods and compensation, obtained the victim's understanding, and pleaded guilty in court, he can be given a lighter punishment according to law. According to the criminal circumstances and repentance of the defendant Wang, the application of probation has no significant adverse impact on the community where he lives, and he can be suspended. The court made the above judgment according to law. The judge said that in social life, people often encounter the situation of scanning QR code, authenticating small programs or downloading APP to send small gifts immediately. The general public should be alert to this situation. They should not leak personal information or even suffer from serious consequences such as fraud due to their greed for small gains. They should not be greedy for small profits. They should accept the request of criminals and spread the fraud related APP to the public.
