In a case | "ride with good intentions", who is responsible for the accident
2022-10-27
In the case, Mr. Zhang drove a motor vehicle home from work, and when his colleague Mr. Wang came home on his way, Mr. Zhang invited Mr. Wang to take a ride, which Mr. Wang readily accepted. On the road, Zhang failed to give way to Yu when turning right, resulting in a collision between Zhang and Yu, which damaged the vehicle and injured Wang. It was confirmed that Zhang was fully responsible for the accident, while Yu was not. Should Zhang be liable for Wang's loss? Zhang's liability for compensation should be reduced according to the case. Article 1217 of the Civil Code stipulates that if the damage caused to the free passenger by a traffic accident of a non operating motor vehicle is the responsibility of the motor vehicle, its liability for compensation shall be reduced, except that the user of the motor vehicle has intentional or gross negligence.
