In order to effectively promote the special action of cracking down on and rectifying old-age fraud according to law, the Supreme People's Court released six typical cases of old-age fraud on the 24th, further clarified the manifestations of six types of key crimes, exposed the "routine" means and harms of old-age fraud, and helped the elderly improve their awareness of the rule of law and their ability to identify and prevent fraud. According to reports, since the people's court launched the national special action to crack down on and rectify old-age fraud in April this year, as of the end of July, the courts throughout the country had accepted 1394 criminal cases of old-age fraud, including 906 cases of illegal fund-raising, 455 cases of fraud, and 33 cases of other types; The court heard 693 criminal cases of the first instance of pension fraud, and announced 1579 people in 603 criminal cases of the first instance and 377 people in 122 cases of the second instance. In addition, since the special action, the national courts have executed more than 2 billion yuan in pension fraud cases. Among the typical cases released this time, Xiao Kaijun and Chen Rong's fund-raising fraud case is a typical criminal case that infringes on the legitimate rights and interests of the elderly in the name of providing "pension services". This kind of crime is mainly manifested in the name of pre-sale of old-age beds, fictitious old-age service projects, and other means to defraud the money of the elderly by handling membership cards, committing services that obviously exceed the supply capacity of beds, and prepaying old-age service fees. Lu Peng's case of illegally absorbing public deposits is a typical criminal case that infringes upon the legitimate rights and interests of the elderly in the name of investing in "pension projects". This kind of crime is mainly manifested as luring the elderly to participate in investment on the grounds of opening a nursing home, buying a pension apartment, and taking a stake in a health care base, and taking regular after-sales rebates and high dividends as bait. The fraud case of Xu Zheng and others is a typical criminal case that infringes on the legitimate rights and interests of the elderly in the name of selling "pension products". This kind of crime is mainly manifested in providing free or low-cost tourism, emotional escort, false publicity and other means, and taking the form of free gifts and health lectures to lure the elderly to buy health care products, food, drugs, medical devices, collectibles or fake and shoddy products at unreasonably high prices. Shen Yiping's fund-raising fraud and Gu Naixiang's illegal absorption of public deposits are typical criminal cases that infringe on the legitimate rights and interests of the elderly in the name of claiming that they "provide for the aged with housing". This kind of crime mainly shows that under the pretext of "the house is useless at home" and "don't delay living or renting", the elderly are enticed to sign a loan contract or relevant agreement guaranteed by real estate mortgage, purchase the so-called financial products recommended by them with the funds obtained from the mortgaged houses, and illegally occupy the old people's houses by means of litigation, arbitration, notarization, etc. Li Xiaolei's fraud case is a typical criminal case that infringes on the legitimate rights and interests of the elderly in the name of handling "endowment insurance". This kind of crime is mainly manifested in lying about knowing the staff of the Social Security Bureau and other departments, or pretending to be the staff of banks and insurance institutions, and can handle "early retirement" and "endowment insurance" on behalf of the elderly, so as to defraud the elderly of insurance premiums, material costs and benefits. Li Jiantao's fraud case is a typical criminal case that infringes on the legitimate rights and interests of the elderly in the name of "supporting the elderly". This kind of crime is mainly manifested in obtaining the trust of the elderly by means of voluntary diagnosis and treatment, psychological care, live escort, charitable donation, voluntary service, organization of cultural activities and other forms, and committing fraud against the elderly.
