The 63rd biweekly Consultative Forum of the 13th CPPCC National Committee was held in Beijing on the 30th. It is believed that the current arbitration law has played an important role in resolving civil and commercial disputes and serving economic and social development since it was implemented for more than 20 years; At the same time, it should also be noted that there are still some problems, such as the narrow scope of accepting cases, the unclear nature of the arbitration institution, the imperfect relevant provisions on arbitrators, the imperfect judicial support, guarantee and supervision mechanism, and the insufficient connection with the international arbitration rules, which cannot meet the needs of the development of the situation and the arbitration practice, and need to be amended and improved. The members suggested that the revision of the arbitration law should appropriately expand the scope of accepting arbitration cases. In principle, all disputes that the parties have the right to dispose of and do not affect public interests can be arbitrated. Referring to international practices, disputes in the fields of intellectual property, international investment, sports and anti-monopoly should be included in the scope of arbitration. It is necessary to improve the arbitration system, further clarify the specific types of arbitration institutions as non-profit legal persons, and require arbitration institutions to establish and improve the corporate governance structure with the separation of decision-making power, enforcement power and supervision power, effective checks and balances, and equal rights and responsibilities, so as to improve their credibility. We should improve the mechanisms for examining the qualifications of arbitrators, selecting and cultivating arbitrators, assessing and evaluating arbitrators, establish an information disclosure system for arbitrators, and strengthen industry self-discipline and supervision. We should improve arbitration procedures and rules and provide economic, convenient and efficient arbitration services for the parties. We should straighten out the relationship between arbitration and litigation, clarify the principles of judicial support and supervision over arbitration, ensure that arbitration is conducted independently according to law, and prevent the tendency of arbitration to be judicialized. We should support the construction of international first-class arbitration centers, support the deepening of international arbitration exchanges and cooperation focusing on countries along the "the Belt and Road", and enhance the international competitiveness and influence of China's arbitration. We should strengthen the construction of arbitration disciplines and personnel training, and build a high-quality international arbitration talent team. It is necessary to strengthen the publicity of law popularization, so that more people can know and understand arbitration, and actively use arbitration to resolve disputes.
