Sniffing technology refers to the short message information acquisition technology that uses the short message sniffing equipment composed of old-fashioned mobile phone motherboard, antenna, laptop and other hardware and corresponding software systems to intercept the short message information sent or received by mobile phone users under the same base station in 2G environment within a radius of 500 meters, and extract the owner's mobile phone number, short message verification code and other contents. From July to August 2021, the defendant Zhao and the defendant Li rented houses in two densely populated communities successively, and synchronously received mobile phone numbers and SMS messages within a radius of about 500 meters by using sniffing equipment and other crime tools purchased by the network. The two use the obtained mobile phone number to log in to the mobile app and network platform to obtain other people's ID number, bank card number and other information, and then use the obtained information to log in to the Internet terminal to steal the money in the victim's account. Through the above means, the two stole a total of 73102.77 yuan from the victim. After the trial, the court held that the defendants Zhao and Li illegally obtained the victim's mobile phone number, ID card number, bank card number, SMS verification code and other information through theft, and used the stolen credit card information through the Internet to steal the money in other people's bank cards, which belongs to the act of falsely using other people's credit cards, and the amount is huge, and their acts have constituted the crime of credit card fraud.
