Dai Bing, Deputy Permanent Representative of China to the United Nations, made a written statement at the high-level meeting commemorating the 40th anniversary of the adoption of the United Nations Convention on the law of the sea (hereinafter referred to as the Convention) on the 29th, pointing out that the Convention is not the whole of the modern law of the sea and should be interpreted and applied in a more goodwill, accurate and complete manner. Dai Bing said that on the 40th anniversary of the adoption of the Convention, all parties should have a more objective, historical and dialectical understanding of the status and role of the Convention, and should interpret and apply the Convention in a more goodwill, accurate and complete manner. The Convention is an important part of the modern law of the sea, but not all. The preamble to the Convention states that matters not provided for in the Convention should continue to be guided by the rules and principles of general international law. The customary international law formed in long-term practice and the rules and norms issued by international sea related institutions also provide important legal norms for global ocean governance. At the same time, the international judicial or arbitration institutions established under the Convention should abide by the principle of state consent and fully respect the right of States to independently choose dispute settlement methods. The Commission on the limits of the continental shelf should strictly abide by the rules of procedure of the Commission, especially the clause of "no consideration in case of dispute", and carefully deal with the submission of the outer continental shelf with land or maritime disputes. With regard to the development of seabed resources, all parties should objectively assess the prospects for deep-sea development and the impact of the COVID-19, and steadily promote the work of the International Seabed Authority in accordance with the principles of seeking truth from facts and gradual progress. Dai Bing said that as a state party to the Convention, China firmly upholds the integrity and seriousness of the Convention, has always been committed to abiding by the international law of the sea, including the Convention, has fully participated in the Convention and the marine governance mechanism under the framework of the United Nations, and has deeply participated in major international legislative processes such as the negotiation of the "international agreement on marine biodiversity in areas beyond national jurisdiction" and the formulation of the "Regulations for the development of international seabed resources", It has played an active role in promoting the construction of modern marine order. China also actively supports the work of the International Tribunal for the law of the sea, the International Seabed Authority and the Commission on the limits of the continental shelf, and regularly contributes to the relevant funds of the Commission and the authority to help developing countries participate in global ocean affairs. Dai Bing said that China is willing to work with all parties to continue to uphold the spirit of the Convention, safeguard the international marine order based on international law, gather consensus on marine governance, promote blue economic cooperation, build a community with a shared future for the oceans, help global economic recovery, jointly build marine ecological civilization and achieve the goal of marine sustainable development.
