The website of the Ministry of science and Technology issued a notice on March 22 to solicit public opinions on the detailed rules for the implementation of the regulations on the administration of human genetic resources (Draft for comments) (hereinafter referred to as the draft for comments). The deadline for feedback is April 21, 2022. Article 11 of the draft stipulates that the collection, preservation and external provision of China's human genetic resources within China must be carried out by China's scientific research institutions, colleges and universities, medical institutions and enterprises (hereinafter referred to as "Chinese units"). Overseas organizations, individuals and institutions established or actually controlled by them (hereinafter referred to as "foreign units") shall not collect and preserve China's human genetic resources in China, nor provide China's human genetic resources abroad. Article 30 stipulates that if human genetic resources information is provided or opened for use to overseas organizations, individuals and institutions established or actually controlled by them, the information backup shall be submitted to the information backup organization designated by the Ministry of science and technology and filed with the Ministry of science and technology. Article 48 requires that the provision or open use of human genetic resources information to overseas organizations, individuals and institutions established or actually controlled by them, which may affect China's public health, national security and social public interests, shall pass the safety review organized by the Ministry of science and technology.
