The Hong Kong Special Administrative Region (HKSAR) government said on the 3rd that the swearing in ceremony for the members of the seventh Legislative Council of the Hong Kong Special Administrative Region of the people's Republic of China was held in the conference hall of the Legislative Council complex of the HKSAR that morning. The swearing in supervisor, HKSAR chief executive Carrie Lam, confirmed that the swearing in of all 90 legislative council members designate was valid. Article 104 of the basic law of the Hong Kong Special Administrative Region of the people's Republic of China stipulates that when taking office, members of the Legislative Council must swear to support the Hong Kong Basic Law and be loyal to the Hong Kong Special Administrative Region of the people's Republic of China. According to the interpretation of Article 104 of the basic law of Hong Kong adopted by the Standing Committee of the National People's Congress on November 7, 2016 (hereinafter referred to as the "interpretation"), the Commissioner of oaths shall be responsible for ensuring that the oath is legally taken, and the oath that complies with the "interpretation" and the laws of the Hong Kong Special Administrative Region shall be determined as a valid oath; An oath that does not comply with the "interpretation" and the laws of the Hong Kong Special Administrative Region shall be determined as invalid and shall not be rearranged. According to the public service (election and appointment) (Miscellaneous Amendments) Ordinance 2021, which came into effect in the Gazette on 21 may 2021, the amended oaths and Declarations Ordinance specifies the chief executive or his authorized person as the Commissioner for oaths sworn by members of the Legislative Council. A spokesman for the HKSAR government said that in accordance with the principles laid down in the "interpretation" and relevant legal provisions, the chief executive of the HKSAR has determined that the oaths of all 90 members of the Legislative Council designate are valid.
