European Court of Justice: Poland must pay a fine of 1 million euros to the European Commission every day
2021-10-28
The European Court of Justice said on the 27th that because Poland did not stop implementing the relevant provisions of its domestic law on the disciplinary review body for judges, the European court ordered Poland to pay a fine of 1 million euros to the European Commission every day. According to the news released by the European Court of justice on the same day, the fine will be implemented from the date when the order is informed to Poland until the date when Poland implements the ruling made by the European Court of justice in July. If Poland refuses to implement the ruling of the European Court of justice in July, the fine will continue until the date of delivery of the final ruling. In July this year, the European Court of Justice ruled that Poland should suspend a disciplinary review body established last year for judges. The Polish government refused to implement and took the issue to its constitutional court. In view of Poland's failure to fulfill its obligations under the ruling of the European Court of justice, the European Commission filed an application in early September to order Poland to pay a fine on a daily basis. In early October, the Polish constitutional court ruled that the European Court of justice interfered with Polish judicial reform and violated the Polish constitution. Polish domestic laws have priority over EU laws. (outlook new era)
