Focusing on 'safety on the tip of the tongue' and strengthening food safety governance through the rule of law

Recently, the Standing Committee of the National People's Congress launched the inspection of food safety law enforcement. This law enforcement inspection focuses on 8 aspects, including key and difficult issues in current food safety governance such as online catering, campus food, infant formula food, pre made dishes, and the use of food additives. The reporter learned that this is the fourth enforcement inspection since the implementation of China's Food Safety Law. The current food safety law in China is known as the "strictest in history", which was promulgated and implemented in 2009 and comprehensively revised in 2015. The Standing Committee of the National People's Congress carried out inspections on the enforcement of the Food Safety Law in 2009, 2011 and 2016. Through law enforcement inspection, we focused on "safety on the tip of the tongue", grasped the prominent problems that affect the implementation of the law and harm the interests of the masses, took the right medicine to the case, and strengthened the rectification, which reflected the high attention of the Standing Committee of the National People's Congress on food safety and the high attention to maintaining the health of the people. According to the provisions of the Food Safety Law, the State Council has established a Food Safety Committee, with the number of member units expanding from the initial 14 to the current 24. Through the comprehensive coordination mechanism for food safety, member units at all levels regularly consult, exchange information, and jointly enforce laws. How does China's food safety governance, guided by the rule of law, achieve legal supervision and scientific governance by implementing the "four strictest" requirements and firmly guarding the bottom line of food safety? Sun Juanjuan, a researcher at the Collaborative Innovation Center for Food Safety Governance of Renmin University of China, said that food safety covers every link from farmland to table, from production and processing to circulation and consumption, involving different subjects and responsibilities. From the perspective of food safety rule of law, whether it is the respective responsibilities of each subject, or the horizontal or vertical coordination between subjects, there are supporting systems in place. For example, ensuring the quality and safety of edible agricultural products requires the agricultural and rural departments and market supervision departments to respectively carry out food safety work related to origin approval and market access. The reporter learned from the State Administration for Market Regulation that currently, China has established three types of food safety sampling systems: national, provincial, municipal, and county level supervision sampling, risk monitoring, and evaluative sampling, covering all major categories of food. On the basis of full coverage of daily supervision and inspection, the market supervision system conducts flight inspections on problem leading enterprises, system inspections on key enterprises, and key inspections on high-risk enterprises. In the past 5 years, a total of 33.32 million batches of food safety supervision and sampling have been completed, and 23000 tons of unqualified food have been removed, sealed, and recalled. Since the beginning of this year, market supervision departments have focused on raw material pollution, counterfeiting, deception and misleading consumption, and organized a special campaign to crack down on counterfeit and inferior food in rural areas. They have carried out investigations and rectification of prominent issues related to edible vegetable oil, focusing on solving prominent problems such as adulteration, substandard products, false labeling, and non-standard delivery, loading, and transportation of edible vegetable oil. They have also carried out rectification of prominent problems related to the excessive use of food additives beyond the scope and limit. The relevant person in charge of the Ministry of Agriculture and Rural Affairs stated that the pass rate of routine monitoring and sampling of edible agricultural products in China has remained stable at over 97% for 10 consecutive years, reaching 98% for the first time in 2024 and 98.3% in the first quarter of this year. Next, the Ministry of Agriculture and Rural Affairs will deepen the innovation and implementation of systems such as classification supervision of production areas and quality and safety traceability, focus on supplementing the limit standards and supporting testing methods for agricultural and veterinary drug residues, and accelerate the environmental governance of production areas and the transformation of traditional production methods. In recent years, the problems exposed in campus food safety have touched the hearts of every parent. The reporter learned that the Food Safety Law regards schools as key places and students as key groups, and sets special provisions to ensure campus food safety through rigid constraints. China has carried out multiple rounds of special rectification on campus food safety. According to the statistics of the Ministry of Education, the coverage of "Internet plus" in primary and secondary school canteens has increased to 98.5%. 70.1% of primary and secondary school canteens implement centralized procurement of large quantities of food materials, and 57.3% of primary and secondary schools establish food material supervision platforms such as food material procurement and purchase inspection. It is reported that in the next step, the Ministry of Education will work with the State Administration for Market Regulation to develop the "Guidelines for the Management of Procurement and Acceptance of Bulk Food Ingredients in School Cafeteria". Strengthen the institutionalization and long-term supervision of monthly school visits by responsible supervisors, continuously urge schools to strengthen problem rectification, and pass each item step by step. Strengthen parental supervision and promote the establishment of parent committees for dietary supervision in primary and secondary schools with full coverage. Urge each primary and secondary school to conduct a food safety satisfaction assessment for teachers and students every semester. Su Jing, a member of the expert group of the State Council Food Safety Commission, stated that inspecting the implementation of the Food Safety Law will help promote relevant departments to further increase regulatory and law enforcement efforts, focus on key areas of food safety that are of social concern, carry out centralized governance, adhere to law based administration and supervision for the people, and promote the improvement of the legal system for food safety, enhance the level of legal protection for food safety in China, and effectively safeguard the "safety on the tongue" of the people.
