The Regulation consists of seven chapters and 48 articles. Compared with the draft for soliciting opinions, a new application scenario of "personal passenger car travel" has been added, providing legal compliance for individual consumers to open up the "intelligent driving" mode. In order to ensure traffic safety, the Regulations stipulate that when an autonomous vehicle breaks down, drives out of a passable area or road, or other circumstances that may affect traffic safety occur, the driver or safety officer shall take measures to reduce the risk of accidents by taking over the vehicle manually, turning on the hazard warning lights, reducing the driving speed, and driving the vehicle to a place that does not hinder the traffic; If an autonomous vehicle violates the laws and regulations on road traffic safety or causes a traffic accident during its passage on the road, the traffic management department of the public security organ shall investigate and deal with it in accordance with the relevant provisions of the State. The use of autonomous driving functions should be standardized in the national standard "Classification of Automotive Driving Automation", where driving automation is divided into 6 levels from L0 to L5. It is understood that L0 level is driven by the driver, while L1 and L2 levels are led by human drivers with system assistance; Starting from Level L3, vehicle control is gradually handed over to the auto drive system. Level L3 is conditional automatic driving, Level L4 is highly automatic driving, and Level L5 is fully automatic driving. The autonomous vehicle referred to in the Regulations refers to the vehicle that can be operated by the auto drive system to drive safely on the road, including the vehicle with conditional autonomous driving, highly autonomous driving and fully autonomous driving functions according to national standards. The industry believes that the implementation of the Regulation means that private cars with L3 level and above intelligent driving level are allowed to legally drive on the road, which not only paves the way for the commercial application of autonomous driving technology, but also provides clear regulatory basis for automobile manufacturers and technology companies to accelerate technological innovation and product research and development. As for personal travel, the Regulations stipulate that autonomous vehicle listed in the automobile product catalogue and meeting the conditions prescribed by the state can be used for personal passenger vehicle travel; Individual passenger car drivers should master and standardize the use of autonomous driving functions in accordance with road traffic regulations and vehicle usage instructions. Like other motor vehicles, autonomous vehicle also need to comply with existing traffic safety laws and regulations. In the event of a traffic accident, the driver, safety officer, or platform safety monitoring personnel shall take necessary safety measures in accordance with regulations and promptly report to the traffic management department of the public security organ; Relevant enterprises and individuals should provide relevant evidence materials such as accident process information or accident analysis reports as required. It is reported that the determination of responsibility for traffic accidents belongs to the legislative power of the state, and local legislation in Beijing has no authority to make regulations. Therefore, the Regulation has been connected with national regulations in this regard, requiring the public security traffic management department to investigate and handle traffic accidents in accordance with relevant national regulations. With regard to the personal information protection and data security issues that are widely concerned by the society, the Regulations propose that enterprises related to the production of autonomous vehicle, the provision of Internet of Vehicles software, communication operations, etc., should establish and improve the data security management system, the collected data should be related to vehicle driving and traffic safety, the processing of personal information should comply with the relevant provisions of the Personal Information Protection Law, and provide query tools and paths for vehicle owners, managers, etc. to view vehicle operation data and users to view data related to accidents and failures during their use. Releasing technological dividends to enhance people's well-being. Recently, Beijing has opened up for the first time autonomous driving travel services in the train station scene. More noteworthy is that the popularity of these "steel partners" is creating new types of employment, with professions such as regional security officers and cloud control dispatchers emerging, transforming technological dividends into people's well-being. The Regulations pointed out that Beijing supports the innovative application activities of autonomous vehicle in multiple scenarios, including ferry connections, sanitation cleaning, public security patrols and other urban operation guarantees, road cargo transportation other than dangerous cargo transportation, and urban bus and trolley bus, taxi, car rental and other passenger transport services other than school bus business, in order to verify new technologies, new scenarios, new products, new models, improve driving and riding experience, and enhance travel convenience and driving safety. Safety is the most concerned topic for car owners, a prerequisite for technological development, and the most important concern for the public, including transportation participants. In this regard, while improving the well-being of the people, the Regulations have made detailed and comprehensive provisions on safety assurance, clearly requiring that road application pilot subjects should have an autonomous vehicle operation safety monitoring platform that can dynamically monitor the operation of vehicles, personnel, networks, etc. in real time. The security officers and platform safety monitoring personnel should ensure the safe operation of autonomous vehicle, and be able to send early warnings and take over the control of vehicles in a timely manner according to emergencies. In addition, pilot entities should strengthen the daily maintenance and testing of operating vehicles, and regularly submit them to third-party testing institutions for safety inspections. To further enhance comprehensive security, Beijing also encourages insurance institutions to develop insurance products that adapt to the characteristics of autonomous vehicle and provide insurance services for relevant enterprises and consumers. In September 2020, Beijing took the lead in planning and constructing the country's first high-level autonomous driving demonstration zone, and carried out key technology verification of the vehicle road cloud integration system to safeguard the high-quality development of the industry under the rule of law. After nearly five years of construction, three stages of iteration have been completed, achieving integrated infrastructure coverage of 600 square kilometers of vehicle road cloud in the city. At present, the demonstration zone has gathered more than 30 domestic and foreign enterprises, nearly a thousand various types of autonomous driving vehicles to carry out innovative application activities such as road testing and demonstration applications, with a cumulative testing mileage of over 32 million kilometers, accounting for more than a quarter of the total testing mileage in the country. During this period, the promoting role of the rule of law runs through the entire process. Previously, the Beijing Intellectual Property Court found that there were still some constraints in the commercialization, data security, and intellectual property protection of the intelligent connected vehicle industry during the trial of a case involving an international company providing autonomous driving services. After in-depth research, the court issued a judicial recommendation to the Beijing High level Autonomous Driving Demonstration Zone Work Office. Based on this judicial suggestion, Beijing has formulated relevant policies for the supervision of data security in intelligent connected vehicles, filling industry loopholes and providing a favorable legal business environment for the high-quality development of international companies. In order to further encourage technological innovation and industrial development, the Regulations propose that Beijing will promote the improvement of the innovation chain and industrial chain of autonomous vehicle, support the manufacturing of autonomous vehicle and core parts, as well as the research and development of autonomous cockpit, autonomous driving solutions and key technologies such as perception, decision, communication and control, promote the iterative optimization of autonomous vehicle product functions, performance improvement and industrial ecology, and promote the high-quality development of autonomous vehicle industry. In addition, Beijing supports enterprises, universities, scientific research institutions, etc. to carry out basic research and application research in the field of autonomous vehicle, promote key core technology research, and support the construction of key laboratories, technology innovation centers, innovation consortiums, common technology research and development platforms in the field of autonomous vehicle. Wang Lei, director of the Office of the High level Autonomous Driving Demonstration Zone in Beijing, said that the Regulations provided a clearer, transparent and predictable system specification for the innovative application of autonomous driving technology. Beijing will continue to carry out the 4.0 phase construction of the High level Autonomous Driving Demonstration Zone, orderly promote autonomous vehicle to move into a wider range and wider scene, accelerate the opening of the airport and railway station to the outside world, deeply promote the construction of tourism, sanitation, logistics, parks and other characteristic scenes, and will create a unified autonomous vehicle service management platform in the city, promote the upload of autonomous vehicle operation data. Relevant demonstration zones will continue to carry out policy innovation, rely on the existing policy system, and cooperate with relevant departments to develop supporting documents for laws and regulations.
