In recent years, with the continuous development of the Yangtze River Economic Belt, urban construction has generated a large amount of construction waste and household waste. Due to limited disposal capacity and high disposal costs, some criminal gangs transfer and dump the above-mentioned construction waste and household waste across provinces (municipalities directly under the central government) to surrounding counties and cities, causing serious pollution and damage to the ecological environment. After identification, the solid waste, soil, and groundwater involved in the case were found to contain heavy metals such as copper, lead, chromium, nickel, zinc, barium, volatile phenols, and fluoride. The chemical oxygen demand and total phosphorus of the groundwater exceeded the third level pollutant discharge concentration standard of the Comprehensive Wastewater Discharge Standard. The mixed waste involved in the case is a mixture of household waste and construction waste, which belongs to the hazardous substances stipulated in Article 338 of the Criminal Law of the People's Republic of China. The estimated cost for the clearance and disposal of the case is about 1.7 million yuan, which has been fulfilled by other defendants who have been dealt with separately. The People's Court of Dongtai City, Jiangsu Province, after trial, found that the defendants Wu Mouyou, Deng Mou, and others violated national regulations by illegally dumping and disposing of harmful substances, constituting the crime of polluting the environment. The defendants Wu and Deng jointly committed an intentional crime with others, which constitutes a joint crime and played a major role in the crime. They are the principal offenders and shall be punished according to all the crimes they participated in according to the law. Due to the illegal dumping and disposal of hazardous substances committed by defendants Wu Mouyou, Deng Mou, and others across provinces (municipalities directly under the central government) in the Yangtze River Economic Belt region, they will be given a heavier punishment as appropriate. The court comprehensively considered various factors such as the motives and purposes of the defendants' actions, the degree of damage to the ecological environment, and sentenced each defendant to imprisonment ranging from three years to one year and six months, and imposed a fine. After the verdict, Wu, Deng and others did not appeal, and the verdict has taken legal effect. The Minutes of the Symposium on Handling Criminal Cases of Environmental Pollution issued by the Supreme People's Court, the Supreme People's Procuratorate, the Ministry of Public Security, the Ministry of Justice, and the Ministry of Ecology and Environment clearly state that those who discharge, dump, or dispose of radioactive waste, waste containing infectious disease pathogens, toxic substances, or other harmful substances across provinces (municipalities directly under the central government) in the Yangtze River Economic Belt region may be punished severely. The Supreme People's Court has stated that the people's courts will increase their efforts to crack down on illegal and criminal activities involving solid waste pollution that seriously damage the ecological environment, especially for illegal and criminal activities involving the discharge, dumping, and disposal of radioactive waste, waste containing infectious disease pathogens, toxic substances, or other harmful substances across provinces (municipalities directly under the central government).
