Data shows that from 2013 to 2024, courts across the country accepted a total of 1145 first instance monopoly civil cases and concluded 1071 cases. From its establishment on January 1, 2019 to the end of December 2024, the Intellectual Property Court of the Supreme People's Court has accepted 282 cases of monopoly civil and administrative second instance, and concluded 243 cases, of which 97 cases were concluded by the court in 2024. In 2024, there were 31 cases determined by courts nationwide to constitute monopolies, a year-on-year increase of 2.1 times. Among them, the first instance court determined that there were 14 cases constituting monopoly, which remained the same year-on-year; The Intellectual Property Court of the Supreme People's Court determined in the second instance that there were 17 cases of monopoly, a year-on-year increase of 4.6 times. In terms of strengthening the judicial regulation of antitrust behavior in key areas, strengthen the judicial strength of antitrust in key areas such as people's livelihood, Internet platforms, medicine, communications, and create a good environment to protect fair market competition and encourage innovation. In terms of striving to unify the rules of judgment, He Zhonglin pointed out that in June 2024, the Supreme People's Court issued the "Interpretation on Several Issues Concerning the Application of Law in the Trial of Civil Disputes over Monopoly", which consists of 51 articles and provides comprehensive and systematic norms for judicial anti-monopoly from procedural operation to substantive legal application. The Supreme People's Court has successively released 3 guiding cases on anti-monopoly, and released a total of 37 typical cases on anti-monopoly in 6 batches, all of which have been included in the court's case database. Among them, 9 typical cases on anti-monopoly will be released in 2 batches in 2024. The release of these judicial interpretations and typical cases plays an important role in guiding the fair and efficient trial of monopoly civil cases by people's courts at all levels and maintaining fair market competition. In terms of strengthening the coordination and cooperation of anti-monopoly law enforcement and judiciary, He Zhonglin stated that by actively accepting and adjudicating subsequent civil lawsuits related to anti-monopoly law enforcement, actively transferring anti-monopoly illegal clues discovered in civil lawsuits to anti-monopoly law enforcement agencies, and lawfully hearing anti-monopoly administrative litigation cases, the organic connection between anti-monopoly administrative investigation and civil compensation can be promoted, and the coordination and unity of administrative law enforcement standards and judicial judgment standards can be achieved, effectively forming a joint force of anti-monopoly law enforcement and judiciary. He Zhonglin mentioned that in the future, the Supreme People's Court will continue to strengthen the judicial work of anti-monopoly, accurately apply the anti-monopoly law and the new judicial interpretation of anti-monopoly civil litigation, focus on Internet platforms, scientific and technological innovation, information security, etc., and at the same time continue to pay attention to anti-monopoly in areas such as people's livelihood, industry associations, intellectual property rights, natural monopoly industries, and administrative power abuse, firmly maintain fair market competition, and help create a more fair and dynamic market environment.
