The reporter learned from the press conference held by the Supreme People's Court yesterday (7th) that last year, a total of 9.1182 million execution cases were concluded by courts across the country, with the executed amount exceeding 2 trillion yuan. Last year, the number of dishonest individuals on the list decreased for the first time in decades. According to the Supreme People's Court, in 2024, the overall execution work achieved a historic "three increases and three decreases", namely, the execution rate, execution amount, and credit repair personnel increased, while the number of first execution cases, civil judgment application execution rate, and the number of newly included dishonest executed persons decreased. Huang Wenjun, Director of the Executive Bureau of the Supreme People's Court: The number of people on the dishonesty list in 2024 has decreased for the first time in ten years. In the first quarter of this year, 394200 new people were added to the dishonesty list by courts nationwide, a further decrease of 9 percentage points compared to the same period last year. At the same time, over 400000 people have completed credit repairs, and the number of people on the dishonesty list continues the downward trend of 2024. Cross execution is an important measure taken by the Supreme People's Court in recent years to promote enforcement reform. It refers to the use of methods such as directive execution, hierarchical execution, and collaborative execution by the court to transfer some difficult to execute cases to other courts for execution, effectively preventing interference from power, relationships, and personal relationships, and improving the quality and efficiency of execution for major, difficult, and complex cases as well as long-term unresolved cases. As of March 31, 2025, there have been nearly 300000 cross execution cases in courts across the country, with substantial progress or resolution of nearly 150000 cases and a total execution amount of nearly 160 billion yuan. For the first time, the Supreme People's Court has released a special guidance case on the implementation of enforcement. Enforcement cases often face difficulties such as difficulty in finding people and property, multiple execution and disposal links, and complex processing procedures. In order to further protect the rights and interests of winning parties in a timely manner in accordance with the law, the Supreme People's Court released a special guidance case on the implementation of enforcement for the first time yesterday (7th), providing guidance and reference for the handling of similar cases. The guiding case released this time clearly states that for enforcement cases involving the dismantling of production equipment involved in intellectual property infringement, the people's court can guide both parties to reach a settlement, replacing the dismantling of relevant production equipment with the payment of technology license fees by the debtor, promoting the legal use of relevant production equipment, and achieving a win-win situation. Another guiding case released this time involves the execution of handling a large number of parking spaces in residential areas. Article 276 of the Civil Code stipulates that "parking spaces and garages planned for parking cars within a building area shall first meet the needs of the owners." In practice, how to understand and grasp the above provisions in cases involving a large number of parking spaces? Zhou Jiahai, Director of the Research Office of the Supreme People's Court: In this case, the execution object involves 73 parking spaces in a certain community, and the parking spaces in the community are tight. The ratio of housing to parking spaces is about 1:0.3. According to the provisions of the Civil Code, the execution court first conducts an auction for the owners of the community, and each owner can only bid for one parking space. If there are unsold parking spaces, auctions will be conducted for unspecified bidders. Through this execution method, the legitimate rights and interests of both the winning party and the executed party are maximally protected, and the provisions of the Civil Code are implemented, meeting the reasonable needs of stakeholders such as community owners. The Supreme Court: Intensify efforts to crack down on refusal to execute judgments and rulings. The Supreme Court stated that it will also intensify efforts to crack down on refusal to execute that seriously disrupts the order of execution. Huang Wenjun, Director of the Enforcement Bureau of the Supreme People's Court: In order to resist enforcement, the executed person often transfers concealed property after the start of the lawsuit, resulting in no property available for enforcement after the judgment takes effect. According to judicial interpretations, if an investigation is conducted in accordance with the law and the person is required to execute but refuses to execute, it can be determined that they have the ability to execute but refuse to execute. If the circumstances are serious, they will be held criminally responsible for refusing to execute the judgment or ruling. At the same time, although the third party is not the executed person, they should also respect the effective judgment. If the third party knowingly refuses to execute the judgment or ruling of the people's court despite knowing that the person with execution obligations has the ability to execute, and colludes with them to assist in hiding or transferring property, resulting in the judgment or ruling being unable to be executed, they should also bear corresponding responsibilities and can be punished as accomplices of the crime of refusing to execute the judgment or ruling.
