Practicing Justice with Life for the Heart of the Early Republic of China - Remembering the National Model Judge Han Xuhui
2024-12-24
Files, documents, pills, and razors are a few simple items that Han Xuhui brings with him on every business trip. As usual, he carried a military style crossbody bag with a hairy edge on his back and set off on his way out to investigate. From Changzhi, Shanxi to Jincheng, from Jincheng to Linfen, and then from Linfen to Yongji, Han Xuhui and his colleagues traveled more than 700 kilometers to four prisons outside the city to hold court hearings and hear five cases. On the evening of March 8, 2023, at the last stop of his business trip in Yongji City, Han Xuhui, who had been exhausted for days, suddenly fell ill and collapsed on the hotel bed. At that moment, he was still holding tightly the materials needed for the next day's court hearing. The next morning, Han Xuhui unfortunately passed away despite unsuccessful rescue efforts. Han Xuhui was a first level judge of the People's Court of Luzhou District, Changzhi City, Shanxi Province before his death. With 33 years of judicial career, 17 years of experience in grassroots people's courts, and over 3000 cases... At the age of 59, he collapsed on the front line of handling cases less than 4 months before retirement. The majestic Taihang Mountains witnessed Han Xuhui's struggle and perseverance, as well as his original intention of practicing justice for the people with his life. Upon hearing the news of Han Xuhui's sudden passing, Wang Liangzhi from Zhangzhuang Village, Machang Town, Changzhi City lifted her apron, wiped away the tears that burst out, and choked up uncontrollably. Wang Liangzhi, who is nearly seventy years old, was one of the plaintiffs in the last batch of cases handled by Han Xuhui before his death. More than ten years ago, she and her husband worked at a local cement factory. The legal representative of the company was imprisoned for a crime, and the workers' wages were also lost. Wang Liangzhi thought that her 7000 yuan salary would never come back, but she heard that a worker in the same situation as them had received their salary with the help of a judge at the Machang Court. She and her husband went to the court with a trial and error mentality to sue. One of the stops on Han Xuhui's business trip before his passing was for the case of elderly Wang Liangzhi. Before going on a business trip, Han Xuhui said to his colleagues, "I'm about to retire. If I handle these few cases well, my heart will be at ease." In fact, Wang Liangzhi is already the plaintiff in the 220th case in this series of labor disputes. This series of cases is not complicated, the difficulty is how to truly help workers get their hard-earned money back. Over the course of 10 years, this series of cases has been heard in court hundreds of times. As the presiding judge, Han Xuhui traveled around, repeatedly verifying, communicating, and coordinating, which was heart wrenching. Lao Han is a scale in our hearts Without him, how could my compensation be received so quickly? "" Lao Han doesn't have any airs at all, he speaks very kindly. "... These words are the most simple voices of ordinary people. From court clerk, assistant judge, judge, deputy director of the enforcement bureau, chief judge of the filing court, chief judge of the people's court, to quitting the chief judge position and continuing to work on the front line of case handling, Han Xuhui has handled "key small matters" that concern the vital interests of the people, allowing the people to truly feel the fairness and warmth of the judiciary. The Machang Court, which resolves conflicts and disputes from the source, is the grassroots court with the widest jurisdiction of the People's Court of Luzhou District. It has a large number of enterprises, villages, and populations within its jurisdiction. Most of the parties who come to the court are villagers from nearby villages, and the disputes are about trivial matters such as "family matters" and "trivial matters". For many years, Han Xuhui has always sat in the audience or clerk's seat before the court hearing, chatting with the parties, understanding the causes of their conflicts, and trying to ease differences and disputes as much as possible. If mediation fails and the case is closed by judgment, he will patiently persuade, explain the law and reason after the trial ends, so that the winning party can be confident and the losing party can take it seriously. In 2016, a pair of neighbors in Zhangzhuang Village, Machang Town had a heated argument over a dispute over building a house on their homestead. After several attempts at mediation by the village committee, the case was ultimately placed on Han Xuhui's desk. Han Xuhui brought tools such as tape measure, camera, and drawings to conduct multiple on-site inspections of both parties' homesteads, inquiring about the dispute from both parties and the village committee, and also visiting the homes of other nearby villagers. As the saying goes, close neighbors are better than distant relatives. Your two families have been neighbors for decades, understanding and empathizing with each other On the basis of thorough investigation, Han Xuhui made a judgment on this dispute, clarifying the right and wrong, and dispelling the knot in the old neighbor's heart. First sit in the public gallery, then sit in the trial chair, first knock on the farmer's door, then knock on the small gavel, first cut off household chores, then explain the legal situation, first find the conscience, then listen to the people's hearts, first get on track with the public, then drive the efficiency car These short five sentences form a set of "Five First Work Methods", which is a microcosm of Han Xuhui's 17 years of roots in grassroots people's courts. In the ups and downs of the hammer, the case was judged fairly, the score was settled, and the dispute was resolved. In April 2022, Han Xuhui voluntarily applied to the court to retire from the position of presiding judge in advance, in order to facilitate the rapid growth of young comrades. At the departure ceremony, he talked about the reasons why he has always been committed to the front line of justice - "It is my love for this job; it is the sanctity of wearing a robe and striking the gavel; it is the responsibility of upholding fairness and justice in judgments; it is the joy of settling disputes." Judge Ma Chenhui of Luzhou Court was a disciple of Han Xuhui. Ma Chenhui still remembers the guidance of his master when he was tired of work: "You must forge yourself into a 'sun', illuminate the court, warm others, and sweep away all the gloom." After resigning from the position of chief judge, Han Xuhui continued to work in grassroots courts and completed more than 200 civil cases in less than a year. Until the last moment of his life, he continued to fight on the front line of the case. On March 9, 2023 at 22:00, a police car carrying the body of Judge Han Xuhui drove past the court where he had stood for his entire life. Many court officers, colleagues, and nearby residents coincidentally came to escort him. Don't you know yet, Han Xuhui personally made a tea jar and prepared to give it to his colleagues when he retires; Han Xuhui was also unaware that his wife and daughter secretly carved a calligraphy seal for him as a retirement gift. He once promised his family, 'When I retire, my family will travel and take good care of my flowers.' However, these gifts and promises were not fulfilled in time. At the memorial service, daughter Han Yannan met many strangers. There are people whose fathers once helped alleviate their worries and difficulties, colleagues who have worked with their fathers for many years, and grassroots workers in local towns and villages. From their grief and memories, Yannan's incomprehension, grievance, and resentment towards his father for being busy with work and neglecting his family gradually dissipated with the wind. She wanted to say to her father the most: "Dad, I also want to be down-to-earth, hardworking, honest and kind like you. I want to become someone like you
