A man used cheating software to modify gas station revenue data in order to evade taxes. Recently, the People's Court of Le'an County, Jiangxi Province, sentenced the defendant Long to 3 years in prison, suspended for 3 years and 6 months, and fined 30000 yuan for the crime of illegally controlling computer information systems. After trial, the court found that starting from August 2022, the defendant Long, in the process of operating and managing a gas station in Le'an County, modified and controlled the parameters of the gas machine's tax control system through a previously purchased tax control cheating software, resulting in a decrease in the monthly revenue reported to the tax control system, in order to achieve the goal of evading taxes. In March of this year, during a joint law enforcement inspection conducted by the Le'an County Public Security Bureau, County Taxation Bureau, and County Market Supervision Administration Bureau, it was found that the metering program used by the gas station's control motherboard was inconsistent with the original factory state, and there was a problem of tampering with the metering program. After appraisal, from August 2022 to the time of the incident, the defendant Long illegally controlled the computer system monitored by the tax department through tax control cheating software to conceal sales revenue and evade taxes totaling more than 480000 yuan. After the incident, the defendant Long paid all the taxes and late fees to the tax department. After trial, the court found that the defendant Long violated national regulations by using illegal technological means to illegally control the tax control system of the fuel tanker. The circumstances were particularly serious, and his behavior constituted the crime of illegally controlling computer information systems. Considering that the defendant has confessed, paid taxes and late fees, pleaded guilty and accepted punishment, and did not cause serious consequences, and after investigation and evaluation by the community correction department, the above judgment is made in accordance with the law.
