On October 25th, the Intermediate People's Court of Guiyang City, Guizhou Province, made a retrial and first instance judgment on the case of Yu Huaying's child trafficking. The defendant Yu Huaying was sentenced to death for the crime of child trafficking, deprived of political rights for life, and had all personal property confiscated. In September 2023, the Guiyang Intermediate People's Court had already sentenced Yu Huaying to death in the first instance proceedings at that time. During the second trial, it was discovered that there were omissions in the crime of child trafficking, and the Guizhou High Court remanded the case for retrial. Human trafficking is a serious criminal act, and China has always maintained a high-pressure and severe punishment situation for such crimes. According to relevant provisions of the Criminal Law, those who steal infants and young children for the purpose of selling, causing serious injuries, deaths or other serious consequences to the abducted women, children or their relatives, shall be sentenced to more than ten years of fixed-term imprisonment or life imprisonment, and shall also be fined or have their property confiscated; Those with particularly serious circumstances shall be sentenced to death and have their property confiscated. Yu Huaying's abduction and trafficking of 17 children not only distorted the fate of the children, but also caused so many families to be separated and even destroyed. Some families paid a huge price for finding their loved ones, and even the bereaved suffered from mental disorders... The nature of the crime is extremely heinous, and the harmful consequences are extremely serious. Without severe punishment, it is not enough to appease public anger and comfort the victims' pain. Although the crime of trafficking women and children has a long time span and evidence is easily lost, no matter how ancient the crime is or how complex the case is, the judicial authorities will overcome numerous difficulties and try their best to restore the case and punish the wrongdoing. This reflects China's sharp attitude towards the crime of trafficking women and children. Looking at the sentencing rules for the crime of trafficking in women and children in the Criminal Law and comparing them horizontally with other charges, it can be found that the sentencing threshold for this crime is five years, which is higher than the sentencing threshold for most crimes. According to media reports, criminals involved in trafficking women and children have been punished severely, and some have been sentenced to death. Cracking down on crime and protecting rights are the responsibilities of judicial organs, as well as the key to maintaining fairness and justice, and enhancing public security and sense of gain. A rule of law society will not overlook any wrongdoing, and the court has demonstrated its determination to severely punish wrongdoing through vivid cases, allowing the people to feel fairness, justice, and a sense of security.
