On August 1, 2022, the State Administration for Market Regulation launched a pilot project to commission market supervision bureaus in five provinces (cities) including Beijing, Shanghai, Guangdong, Chongqing, and Shaanxi to conduct anti-monopoly reviews on business concentration. Over the past two years, a total of 854 centralized declaration cases have been entrusted to 5 pilot provincial market supervision departments, accounting for 57.74% of all simple cases during the same period. The quality and efficiency of anti-monopoly reviews for the concentration of entrusted operators in five regions have steadily improved. From March to July 2024, the State Administration for Market Regulation will conduct a mid-term evaluation of the pilot commissioning work. The evaluation focuses on more than 60 indicators and is conducted through various methods such as departmental evaluation, self-evaluation by provincial (municipal) bureaus, enterprise law firm symposiums, satisfaction survey questionnaires, and field research. The evaluation results show that the State Administration for Market Regulation has promoted the implementation of the "Provisions of the State Council on the Standards for Declaration of Concentration of Business Operators", revised the "Provisions on the Review of Concentration of Business Operators", "Work Rules for the Review of Concentration of Business Operators", etc., and provided more complete institutional guarantees; Launching the anti-monopoly review system for concentrated business operators, pilot provinces (cities) will radiate to the eight northern provinces, the Yangtze River Delta region, the Guangdong Hong Kong Macao Greater Bay Area, and the northwest provinces along the Silk Road, and the regional coordination mechanism will be further improved. Review and regulation are more efficient. Data shows that since the pilot commission work was launched 2 years ago, the average acceptance time for commissioned review cases has been 18.1 days, and the average completion time has been 17.15 days. Especially since 2024, the average acceptance time has been only 15.36 days, and the average completion time has been only 16.48 days. The review efficiency ranks among the top in the world's major antitrust jurisdictions. The competitive atmosphere is more intense. Local collaborative efforts are being made to create a "integrated media+5G" publicity model, enriching the forms of anti-monopoly review for business concentration, and enhancing the compliance awareness of business entities. In order to improve the targeting of publicity, pilot provinces (cities) have established a list of key enterprises in conjunction with daily supervision, and have joined forces with local state-owned assets supervision commissions, industry associations, and other institutions to increase publicity efforts for state-owned enterprises and enterprises above designated size. Through forms such as "private enterprise special sessions," "law firm special sessions," and "state-owned enterprise special sessions," publicity has been carried out to help enterprises avoid the risk of illegal concentration of operators.
