On the morning of September 11, the 11th meeting of the Standing Committee of the 14th National People's Congress deliberated the draft national park law in groups. During the group review, participants generally believed that the formulation of the National Park Law is of great significance for promoting high-quality national park construction, comprehensively improving the level of national park protection and management, and accelerating the modernization of harmonious coexistence between humans and nature. The draft implements the concept that green mountains and clear waters are as valuable as mountains of gold and silver, adheres to the principle of ecological protection first, and is based on the practice of national park construction in China. It makes clear provisions in establishing a unified management system, standardizing planning and establishment, strengthening protection and management, promoting participation and sharing, and strengthening guarantee and supervision. It transforms the decision and deployment of the Party Central Committee on establishing a national park system into a legal system, which is of great significance for solidly promoting national park construction, maintaining national ecological security, and promoting modernization of harmonious coexistence between man and nature. The Third Plenum of the 20th Central Committee of the Communist Party of China proposed to comprehensively promote the construction of a natural protected area system with national parks as the main body. Member Shahheti Ahan suggested adding this content to the first article of the draft, and through legal procedures, making the party's propositions the will of the state and elevated to national laws. During the deliberation, several attendees put forward suggestions on further refining the responsibilities of national park management agencies and building a scientific and effective national park management system. Article 6 of the draft provides provisions for the management agencies of national parks. Considering the special importance of the national park management organization in the whole national park management system, Li Gao, a member of the Environmental and Resource Protection Committee of the National People's Congress, suggested that the establishment, nature and responsibilities of the national park management organization should be more carefully and clearly stipulated in this law. Member Huang Zhixian also believes that the responsibilities and rights of national park management agencies in Article 6 of the draft should be further clarified, which is conducive to the management of national parks by relevant agencies and their ability and role. Members of the Lu Xin Society noticed that Article 6 of the draft generally stipulates the management system of national parks, and relevant provisions regulate the specific responsibilities of each regulatory body, but the expression is relatively vague. He suggested further clarifying the management responsibilities of various entities, clarifying the responsibility system, regulatory system, and law enforcement entities of national parks, and clarifying the responsibilities of relevant departments in ecological protection, natural resource asset management, franchising, monitoring and evaluation, scientific research and education, and other aspects. Member Yang Yongying also pointed out that the responsibilities of the national park management agency in the draft are not clear and specific enough. It is suggested to further refine and increase the ecological supervision responsibilities of the ecological environment department for national parks. At the same time, it is recommended to establish a third-party supervision and evaluation system, enrich the content of information disclosure and encourage public participation, to ensure more objective evaluation and supervision. The committee members of Xiantie have focused on how to handle the relationship between protection and development effectively. He pointed out that national parks are not only key areas for the protection of biodiversity and ecosystem functions, but also important bases for conducting scientific research, implementing environmental education, inheriting ecological culture, and developing ecotourism. The construction of national parks should balance protection and development, while adhering to the principle of protection first, it should also ensure the survival and development of indigenous residents. National parks are generally located in underdeveloped areas, often ethnic minority areas and remote areas. Therefore, in the construction of national parks, the protection of the rights and interests of indigenous residents cannot be ignored, and their legitimate rights and interests must be effectively protected. Considering the generally weak financial and human resources of the government where the national park is located, Xiantie can suggest reflecting the public welfare attributes of the national park in legislation, increasing ecological compensation based on location, protection scale, and effectiveness, especially providing special policy support to border ethnic areas, establishing a national park funding guarantee mechanism mainly based on financial investment, clarifying the rigid requirements for funding guarantee, and gradually increasing the central government's transfer payments.
