Two men in Urumqi were sentenced for selling fake Baijiu at a lower price than the purchase price

Recently, in a waste recycling station in Shuimogou District, Urumqi, Xinjiang Uygur Autonomous Region, a destruction operation of fake and inferior Baijiu was under way. At the scene, more than 100 boxes of fake and low-grade Baijiu were stacked neatly. With the order of the police, bottles of fake and inferior Baijiu were poured into the chemical pool, and the bottles were smashed one by one. The entire destruction process lasted for over an hour, and over a ton of counterfeit alcohol was all destroyed in accordance with the law. Thus, the counterfeit alcohol case that lasted for over a year has been concluded. At the beginning of 2023, the Shuimogou District Branch of Urumqi Public Security Bureau received a report from the masses that the high-end Baijiu sold by a tobacco and alcohol firm in the area under its jurisdiction was suspected to be fake. After receiving the alarm, the police launched an investigation based on relevant clues. I often purchase goods from their store A shopkeeper said that the tobacco and wine firm sold the medium and high-grade Baijiu that was in demand on the market at the "purchase price", sometimes even lower. The supply of goods is stable and the prices are affordable. For a period of time, this tobacco and alcohol business has received continuous positive reviews and its business has been very prosperous. At the beginning, many shop owners had doubts about the low-priced Baijiu sold by the firm, but each time the other party generously asked the buyer to open the box for inspection, and the Baijiu sold was not questioned by customers. Is there no problem with the quality, and we're not making any profit from the price difference? In order to find out the truth, the police expanded the scope of their visits and did a lot of investigation. After that, they found that the number of Baijiu sold to the tobacco and liquor store by the Baijiu manufacturer was very different from the number sold, and the sales amount was nearly doubled. Where did these Baijiu come from when they bought less and sold more? After discovering the abnormal situation, the police immediately reported to the higher-level public security organs and initiated an investigation. In the process of squatting, the police found a white van full of doubts. The van did not belong to any Baijiu sales manufacturer, but it often sent all kinds of medium and high-grade Baijiu to the business. The police tracked and investigated the truck and found two people inside. In just one afternoon, the two people drove to five liquor and tobacco firms to deliver goods to their homes, most of which were medium and high-grade Baijiu. After the delivery was completed, the truck drove into a remote courtyard and stayed for half an hour before leaving. The police were divided into two groups, one group continued to follow, the other group went into the yard to explore, and found that a small bungalow at the corner was full of Baijiu, which was difficult to distinguish between true and false. Shortly afterwards, another group of police officers received news that the truck had stopped in a residential area and two people inside walked into a self built house. To prevent startling the snake, the police waited until the two men left the next day and entered the self built house for investigation. A strong smell of wine came to the face. Through the window, the police saw a large number of wine bottles and various kinds of packaging boxes of Baijiu in the room. According to various signs on the scene, the police judged that it was most likely a Baijiu counterfeiting dens. After self-study and investigation, it was found that the two men on the truck were named Li Gang (pseudonym) and Li Qiang (pseudonym), and they were cousins with no fixed occupation. After a month of investigation, the police confirmed that the two brothers provided fake alcohol and had access to their counterfeit production and sales channels. In June last year, the police launched a network capture operation, capturing two suspect, two fake dens, three fake liquor warehouses, nine tobacco and alcohol firms involved, and more than one ton of medium and high-end Baijiu, such as Moutai and Wuliangye, which was identified by professional institutions as involving more than 1.5 million yuan. The police estimated that, with the sold fake liquor, the two people forged more than 4 tons of fake Baijiu, making an illegal profit of more than 700000 yuan. In 2022, brothers Li Gang and Li Qiang, due to financial difficulties, set their sights on the highly profitable counterfeit alcohol industry in order to earn more money. According to Li Gang, they accidentally flashed a video on the Internet. The anchor in the video randomly sought passers-by to taste Baijiu and identify the grade and authenticity. It was found that most people could not distinguish between them. The two of them sensed a 'business opportunity' from it. Later, the two brothers bought all kinds of medium and high-grade Baijiu and personally tasted them. They found that the taste of high-end Baijiu was very similar to that of some bulk Baijiu. So they began to look up information on the Internet to learn the production process of Baijiu. "Our wines are all mixed with bulk liquor and essence." Li Gang said that the two of them have a low level of education. After searching for information, studying, and researching online, they practiced and tasted the wine multiple times, constantly comparing it with real wine. After nearly a hundred attempts and changing the blending ratio, they finally succeeded in the experiment, and the taste was almost indistinguishable from real wine. The issue of taste was resolved, and the two of them began to ponder over the problems of wine bottles and packaging boxes. The two brothers recycled from retail investors or bought brand liquor bottles from recycling stations in the local area, and often stayed at some liquor and tobacco stores to steal the Baijiu boxes thrown away by the shopkeeper when he was unprepared. However, the packaging boxes obtained through these methods were obviously insufficient. Soon, Li Qiang searched for people selling high-end Baijiu packaging boxes and boxes online and bought them in large quantities. The first batch of fake Baijiu produced by Li Gang and Li Qiang sold out in October 2022. The two of them gradually became bolder and began mass production and sales. To cover up, both of them personally completed all the production and sales processes, without even knowing about their families. At the beginning, the two brothers still had some obstacles in selling a large number of fake Baijiu, because most stores had their own fixed suppliers and were not interested in wine of unknown origin. But during a "street sweeping" sale, the person in charge of a tobacco and alcohol business, Wang Yong (pseudonym), was very "attentive". Although Wang Yong discovered on the spot that the wine was fake, after tasting it, he expressed his willingness to cooperate due to the low price. After negotiation, Wang Yong pressed down the price to buy a bottle of Baijiu with a market price of more than 100 yuan. He was only willing to bid 20 yuan for the purchase, or even lower. He also promised to introduce other tobacco and wine stores to the two people. Although the Li Gang brothers were dissatisfied, they could only agree in order to open up sales channels. The police learned that in the process of selling this batch of fake liquor, Wang Yong and others initially provided genuine products. After gaining the trust of customers, the authenticity began to be mixed, and in the end, there were more fake products and fewer real ones. In this way, the illegal behavior of the two brothers was not stopped in a timely manner, but instead grew stronger and formed a stable manufacturing and trafficking gang. Under the operation of the gang, batches of fake and inferior Baijiu entered the market, until it was "a nest of end" by the public security organ. Recently, the court made a judgment in accordance with the law, and the defendants Li Gang and Li Qiang were convicted of the crime of selling counterfeit registered trademark goods. Li Gang was sentenced to 3 years and 6 months in prison, Li Qiang was sentenced to 3 years in prison, and fined 200000 yuan. Other individuals involved in the case have also been dealt with in accordance with the law, and the relevant tobacco and alcohol trading companies involved have been handed over to the market supervision and management department for punishment.
