The Supreme People's Procuratorate recently released a batch of typical cases of procuratorial organs serving the construction of national parks, guiding procuratorial organs in various regions to fully play their public interest litigation procuratorial functions, better serve the protection of national park construction, and promote high-level ecological environment protection. The typical cases released this time include 6 administrative public interest litigation cases, including 5 administrative public interest litigation cases and 1 civil public interest litigation case, in which the procuratorial organs of Guoluo Tibetan Autonomous Prefecture in Qinghai Province urge the protection of species habitats in the core area of Sanjiangyuan National Park. The case involves the first five national parks established in China and six provinces including Jilin, Fujian, Jiangxi, Hainan, Sichuan, and Qinghai. From the perspective of the protected objects of the case, it involves not only snow leopards, Amur tigers and leopards, Hainan slope deer and other protected animals, but also plants that play an important role in the ecological environment of the national park, such as Tianquan maple, Mount Wuyi pine trees. The means of public interest protection include both urging administrative agencies to perform their duties in accordance with the law through administrative public interest litigation, and initiating civil public interest litigation to pursue civil liability of violators.
