The reporter recently learned from the Ministry of Justice that from June to December 2024, the Ministry of Justice, in conjunction with the National Development and Reform Commission and the All China Federation of Industry and Commerce, will carry out a special action to safeguard the high-quality development of enterprises through administrative reconsideration. This includes unblocking channels for administrative reconsideration applications, implementing substantive resolution of administrative disputes, increasing supervision of administrative law enforcement in enterprises, playing the role of administrative reconsideration in preventing administrative disputes in enterprises, and strengthening the tracking and effectiveness of administrative reconsideration cases in enterprises. In terms of increasing supervision over administrative law enforcement related to enterprises, it is required to correct prominent issues such as heavy penalties for minor mistakes, substituting punishment for management, and increasing income through punishment. Provincial government administrative review agencies have selected 1 to 3 major administrative review cases related to enterprises for listing and supervision. In terms of strengthening the tracking and effectiveness of administrative reconsideration cases involving enterprises, it is required to establish a mechanism for follow-up work on administrative reconsideration cases involving enterprises. During the special action period, a systematic review will be conducted on the implementation of administrative reconsideration decisions, opinions, and mediation agreements related to enterprises in the past 5 years, and the implementation will be supervised to ensure their effectiveness. The three departments require that enterprises identify difficulties and problems in resolving administrative disputes, and enhance the targeted and effective nature of administrative reconsideration.
