Provide more legal basis for the development of low altitude policing

With the development of modern technology, drones have been widely used in various fields such as agriculture, logistics, and environmental monitoring, and have played an important role, especially in handling emergencies, large-scale event security, forest fire prevention, and other public safety fields. Their role is very obvious. During the Loong Boat Festival, local public security organs launched different numbers and models of police UAVs according to work needs, ensuring the safety of large-scale mass activities, which also highlights the importance of low altitude policing. Currently, low altitude airspace, as a valuable resource, is increasingly valued by all parties, and general aviation equipment is fully integrated into various fields of people's production and life. With the increasing popularity of various remote-controlled helicopters and multi rotor aircraft that are easy to operate, incidents of "black flying" drones interfering with aviation order and prying into the privacy of others have occurred frequently, posing a serious challenge to public security management. The development of low altitude policing has become a demand of the current society and era, and is of great significance for building a higher level of safe China. Firstly, developing low altitude policing is necessary for maintaining national security. The airspace is an important component of a country's territory and is sacred and inviolable. Developing low altitude policing is a necessary requirement for protecting national low altitude airspace security in today's risk society. Secondly, developing low altitude policing is necessary to protect the safety of people's lives and property. Low altitude airspace belongs to natural resources. According to the Constitution, natural resources belong to the state, that is, to the entire population. Low altitude airspace is closely connected to the lives of the people, and the development of low altitude policing is to protect the happiness and tranquility of the people. Once again, developing low altitude policing is necessary to safeguard economic development. In recent years, the low altitude economy has rapidly emerged and demonstrated strong industrial radiation, and is even expected to give birth to a trillion level industrial scale. The development of the economy has put forward higher requirements for safety and security, which can maintain low altitude public order and provide protection for the low altitude economy. Finally, the development of low altitude police is necessary for the modernization of public security work. The use of modern technology to develop low altitude police is an important way to implement the strategy of strengthening police through science and technology, accelerate the formation and improvement of new quality public security combat effectiveness, and achieve modernization of public security work. However, the current low altitude policing in China is still in its early stages, and there are still many development obstacles, mainly manifested in: firstly, the laws and regulations are not yet sound. Although there are currently many laws and regulations related to low altitude supervision in China, such as the Civil Aviation Law and the Provisional Regulations on the Management of Unmanned Aerial Vehicles, and existing laws and regulations also specify the management responsibilities of public security organs, these regulations are relatively macro level and do not provide strong guidance for the development of specific low altitude police services. Secondly, the responsibilities and functions still need to be determined. According to relevant laws and regulations, multiple departments in China should participate in low altitude governance. For example, the supervision of drones involves multiple management departments such as civil aviation, public security, and industry and information technology. The handling of the same illegal case may involve collaboration among multiple departments, and instructions from different departments may overlap or even conflict with each other. Thirdly, the development plan is not yet clear. At present, most grassroots public security organs in China have insufficient understanding of low altitude governance, and their understanding of low altitude policing is limited to the supervision of drone "black flying" cases. They even separate the prevention and control of low altitude illegal crimes from the crackdown on them, and have not made scientific and feasible development plans for low altitude policing. Fourthly, the professional team has not yet formed. At present, only a few provincial-level public security organs in China have established police aviation brigades, and the vast majority of prefecture level and county-level public security organs have not established specialized low altitude police types. They temporarily place the functions of low altitude policing on special patrol officers, public security and other police types. Without a professional team, it is not conducive to maintaining low altitude public order. To address these issues, it is first necessary to strengthen legal support. The country should accelerate the construction of the rule of law for low altitude governance, further strengthen legislation, and improve the low altitude rule of law system as soon as possible, so that the governance rights and responsibilities of various departments are clearer, and the development of low altitude policing has more legal basis. Secondly, we need to further enhance our understanding. In fact, the main task of low altitude policing is to prevent and combat low altitude illegal crimes and maintain low altitude public order. Its development is not only necessary for the current era, but also for future development. Although low altitude policing is the responsibility of the public security organs, it also requires the support and cooperation of various relevant departments, clarifying rights and responsibilities, vigorously coordinating, and forming a joint force. Once again, we need to strengthen planning. Low altitude policing takes low altitude airspace as the field, relies on low altitude technology, and manages low altitude vehicles (including manned and unmanned). It covers specific business areas such as low altitude traffic management, low altitude security management, low altitude criminal investigation, and emergency policing. Public security organs should strengthen research, master and develop core technologies, and carefully plan their layout. Finally, strengthen team building. With the advancement of low altitude technology, low altitude policing will become increasingly important. Public security organs should focus on the present and the future, establish low altitude police types as soon as possible, and develop specialized low altitude policing teams.
