On June 1st, the launch ceremony of the "Anti Money Laundering and Financial Security" high-end forum and research project jointly organized by Peking University Law School and Ant Group was held in Beijing. Guo Li, Secretary of the Party Committee and President of the School of Law of Peking University, Zhang Xiaojin, Director of the Third Procuratorial Office of the Supreme People's Procuratorate, Luo Yang, Chairman of the Internet Finance Anti money Laundering Professional Committee of the China Internet Finance Association, and Wang Lijuan, Vice President of Ant Group and General Manager of Alipay Digital Government Enterprise Business Department, attended the forum and delivered a speech. The event was hosted by Wang Xin, a professor of the School of Law of Peking University. More than 130 experts from regulatory, law enforcement, judicial, university, and industry institutions attended the meeting, and the forum held in-depth discussions on hot topics such as "anti money laundering and financial security", "dual connection of anti money laundering execution", "performance of anti money laundering obligation institutions", and "anti money laundering financial technology and innovation practice". Wang Xin stated that anti money laundering is an important part of modernizing the national governance system and governance capacity. Currently, China is facing important tasks such as revising the Anti Money Laundering Law and conducting the fifth round of international mutual evaluation on China's anti money laundering work by the Financial Action Task Force (FATF) next year. This high-end forum aims to build a platform, gather wisdom from all parties, gather strength from all parties, and jointly serve China's anti money laundering cause, to ensure the smooth revision of the Anti Money Laundering Law and better welcome the fifth round of international mutual evaluation conducted by FATF on China's anti money laundering work. Guo Li stated that this year marks the 120th anniversary of the establishment of the Law discipline at Peking University. For a long time, Peking University Law has always been a strong promoter of China's rule of law construction and a steadfast defender of China's national security. In the new era, the Party and the state attach great importance to financial security and regard it as an important component of the overall national security concept. Zhang Xiaojin, based on the actual work of procuratorial work, exchanged experiences and practices of procuratorial organs in the new era to ensure high-quality development of finance by accurately understanding and grasping the current situation of anti money laundering work, strengthening responsibility, fully playing the role of financial crime procuratorial functions, punishing and preventing money laundering crimes in accordance with the law, and further effectively cracking down on money laundering crimes from three perspectives. Luo Yang stated that new technologies have a double-edged sword effect in the field of anti money laundering, bringing both challenges and opportunities, especially in the application of cutting-edge technologies such as big data, cloud computing, blockchain, and artificial intelligence. Although they have improved the concealment and destructive nature of money laundering, they also provide new tools and means for anti money laundering. In the future, efforts need to be made to address issues such as unified standards and information security, in order to fully leverage the empowering role of financial technology in the digital transformation of anti money laundering. After the launch ceremony of the research project, the forum entered the keynote speech segment, which was presided over by Liu Yanhong, Dean of the School of Criminal Justice at China University of Political Science and Law. Ye Qingguo, Director of the Institutional Department of the Anti Money Laundering Bureau of the People's Bank of China, gave a detailed introduction to the commonly concerned issues in the revision process of the Anti Money Laundering Law, such as "defining the concept of anti money laundering", "risk-based", "emerging money laundering risks", and "how to maintain a balance between managing money laundering risks and optimizing financial services". Based on the practice of anti money laundering work in the procuratorial organs, Prosecutor Bei Jinxin, the organizer of the Fourth Procuratorate of the Supreme People's Procuratorate, proposed that in order to address the challenges faced in anti money laundering criminal justice work, efforts should be made to build "three consensuses" in the future, that is, to strengthen consensus on the importance of anti money laundering, to build consensus on the understanding and application methodology of money laundering crimes, and to cultivate consensus between anti money laundering theory and practice. Professor Tian Hongjie from the Criminal Law Science Research Center of Renmin University of China, with the theme of "penetrating governance of encrypted assets", proposed that effective criminal governance of encrypted assets must be carried out within the existing legal framework. It is necessary to use penetrating thinking, grasp the financial attributes of encrypted assets, and reasonably allocate the three-dimensional financial stability obligations of financial project developers, edge service providers, and financial institutions, providing favorable focus for criminal governance. Subsequently, the forum entered a special discussion session. The topic of the first unit's discussion is "Bilateral Connection of Anti Money Laundering Enforcement", hosted by Professor Zhang Lei from the Criminal Law Science Research Institute of Beijing Normal University. Li Qing, Deputy Director of the Investigation Department of the Anti Money Laundering Bureau of the People's Bank of China, introduced the significance of doing a good job in the connection between anti money laundering and execution, as well as the achievements made in the past period. He also proposed to continue to improve the system and mechanism of the two-way connection between anti money laundering and execution, and to play the role of the procuratorial organs in connecting the upper and lower levels, organizing and coordinating in the two-way connection between execution, while strengthening the sharing and exchange of data, information, personnel and other essential resources. Lv Meiqing, Deputy Prosecutor General of the Fourth Branch of the Beijing People's Procuratorate, introduced the problems encountered in the connection between anti money laundering and execution, as well as the difficulties faced by non bank payment institutions in conviction, based on specific cases. Wang Haihong, Vice President of the Third Intermediate People's Court of Beijing, used data to share the specific situation of the Third Intermediate People's Court in handling money laundering criminal cases. She pointed out that current money laundering cases face difficulties such as an increase in the amount of money involved, weak social discrimination, and frequent new money laundering methods. She also exchanged experiences with the attending guests on strengthening money laundering governance in the Third Intermediate People's Court and helping to prevent financial risks in the capital. The topic of the second unit's discussion is "Performance of Anti Money Laundering Obligation Institutions", chaired by Ma Li, General Manager of the Anti Money Laundering Management Department of China Minsheng Bank. Liu Lihong, Director of the Anti Money Laundering Department of the Beijing Branch of the People's Bank of China, gave a speech with the theme of "Risk oriented: Creating a new situation of differentiated, predictable, and sustainable anti money laundering supervision", explaining the challenges faced by current anti money laundering supervision and exploring corresponding solutions from the perspectives of legislation and law enforcement. Qin Ying, General Manager of the Anti Money Laundering Center of Guangfa Bank, introduced to the guests the "Six Modernizations" new infrastructure project launched by Guangfa Bank to promote anti money laundering work, with the theme of "original intention as solid as a rock and steadfast commitment to the future". Guo Jiming, the compliance officer and general manager of the legal compliance department of Ping An Life Insurance Co., Ltd. of China, shared the characteristics of the insurance industry in fulfilling anti money laundering obligations based on the actual situation of Ping An Life Insurance. Liu Chang, Deputy General Manager of Ant Group's Anti Money Laundering Center, shared the common new technological risks and Ant Group's response strategies with the topic of "Innovative Practice in Monitoring and Analyzing Money Laundering Risks in Payment Institutions". Ren Zhiyi, a partner of Fangda Law Firm, discussed in detail the key points for specific non-financial institutions to fulfill their anti money laundering obligations in conjunction with the specific content of the revised draft of the Anti Money Laundering Law for public consultation. The topic of the third unit's discussion is "Anti Money Laundering Management Practice and Technological Innovation", chaired by Deng Wei, Deputy General Manager of the Global Anti Money Laundering Center of the Internal Control and Compliance Supervision Department of the Agricultural Bank of China. Shen Kesheng, Deputy General Manager of the Internal Control and Compliance Department of China Postal Savings Bank, summarized three experiences of the bank in promoting the effective transformation of anti money laundering work, including continuous promotion of customer due diligence, emphasis on technology empowerment, and improvement of anti money laundering job benefits. Zhou Gang, a senior anti money laundering expert at the head office of China Merchants Bank, discussed with attendees the experience and lessons learned from China Merchants Bank's implementation of intelligent, online, and data-driven anti money laundering transformation since 2017. Zhang Ziwei, Director of the System and Monitoring Department of the Legal Compliance Department of the Head Office of Shanghai Pudong Development Bank, pointed out that while promoting anti money laundering work requires attention to technology, excessive superstition about technology should be avoided. Wang Xin, the head of the Compliance Monitoring and Analysis Center of CITIC Securities, shared the experience of securities companies using financial technology to build anti money laundering systems, effectively identify abnormal transactions, strengthen compliance management and risk control. Song Bowen, Algorithm Director of Ant Group's Anti Money Laundering Center, reported on Ant Group's innovation and practice in graph technology. Liang Kaipeng, Vice President of Beijing Yinfeng Xinrong Technology Development Co., Ltd., discussed the application of technology empowerment in the field of suspicious transaction monitoring and reporting with all participants from the perspective of being a third-party service organization.
