Developing the tourism economy requires the assistance of the rule of law

In recent years, with the help of the "Olympic effect", ice and snow sports and ice and snow tourism have been continuously heating up. As a province with abundant ice and snow resources, Heilongjiang Province relies on its unique geographical advantages and abundant ice and snow resources to accelerate the transformation of "ice and snow" into "golden mountains and silver mountains". Heilongjiang Province has established a provincial-level joint conference mechanism to promote the development of ice and snow economy, with provincial leaders as the overall convener. It has studied and issued a series of documents such as the "Development Plan for Ice and Snow Economy in Heilongjiang Province (2022-2030)" and "Several Policy Measures to Support the Development of Ice and Snow Economy in Heilongjiang Province", opening up new paths and exploring new models for the development of China's ice and snow economy. The jurisdiction where the Yabuli People's Court is located has the famous Phoenix Mountain National Geopark, Yabuli Ski Resort, and Snow Village Scenic Area. Every year, a large number of tourists and skiing enthusiasts from all over the world come here to enjoy the silver covered forest, the misty rime everywhere, and experience the passion of ice and snow sports. It is the duty of the judicial organs to create a rule of law business environment for the "ice and snow". In April of this year, the Higher People's Court of Heilongjiang Province and the Provincial Department of Culture and Tourism jointly issued the "Opinions on Establishing a Linkage Mechanism to Promote the High quality Development of Heilongjiang's Tourism Industry in accordance with the Law", proposing the establishment of cooperation mechanisms such as litigation source governance cooperation and joint legal education, to promote the transformation of tourism in Heilongjiang from "one region, one season" to "all regions, all seasons". We are solidly promoting the implementation and refinement of various policy measures in our work. Based on the characteristics of most tourism disputes, such as remote locations, low value involved, complex relationships involved, and a group of dispute subjects, starting from 2021, we have identified the combination of judicial services and ice and snow tourism, focused on increasing the judicial protection of ice and snow tourism, created the "Hao Judge" judicial brand, established the "Hao Judge Tourism Circuit Court" in scenic areas, and opened a "green channel" for judicial services to the ice and snow economy. We adhere to putting the people at the center, actively performing our duties, adapting to local conditions, practicing the "Fengqiao experience" of the new era, polishing the "Judge Hao" judicial brand, and serving to ensure the high-quality development of the ice and snow economy in Longjiang. Nowadays, the judicial services of the Yabuli People's Court have extended to every corner of the scenic area, constantly guarding the merchants and tourists in the scenic area. At the same time, we actively coordinate and integrate the resources of the Forestry Bureau Co., Ltd., the Forest District Public Security Branch, the Procuratorate, and the People's Mediator in our jurisdiction. Based on the characteristics of "Judge Hao" being close to the grassroots people, we have created a new model of "5+1=0" litigation source governance work, which is a conflict resolution model of "five units' litigation source governance mediation personnel+conflict dispute resolution". Since the end of 2023, the "5+1=0" litigation source governance joint mediation room has received more than 620 visitors for consultation, resolved 1677 conflicts and disputes, successfully mediated 195 ice and snow tourism disputes before litigation, and mediated 996 conflicts and disputes before litigation through five parties, none of which entered the proceedings. In order to better serve the ice and snow tourism related work in our jurisdiction, we also took the initiative to communicate with the Yabuli Management Committee of Harbin City and joined the Yabuli Snow Competition Area Work Special Team of the 9th Asian Winter Games Executive Committee. By providing professional judicial services, assisting in maintaining the legal order of the competition area, establishing a special working group, and providing legal service personnel, we will contribute our legal strength to the smooth convening of the 9th Asian Winter Games, providing high-quality judicial services and guarantees. Continuously improving the level of judicial trial work and providing strong services to ensure high-quality economic and social development is the unwavering pursuit of the people's courts. We should take "vertical competition for promotion, horizontal competition for position, and work to create a brand" as the overall focus, deepen the construction of capacity and style, and improve quality and efficiency as the main line, focusing on achieving modernization of judicial work. One is to promote the establishment and improvement of diversified resolution and linkage mechanisms. Give full play to the functions of the "Judge Hao Tourism Tour Court" and the "5+1=0" Joint Mediation Room for Source Governance, deepen legal publicity and education through activities such as legal education and legal transmission to enterprises, guide tourism service enterprises to establish a firm concept of law-abiding business, enhance tourists' awareness of legal rights protection, and effectively avoid the occurrence and intensification of conflicts and disputes. The second is to promote the deepening of a new pattern of "5+1=0" litigation source governance. Strengthen the governance of tourism conflicts and disputes at the source, establish a close work coordination mechanism with the cultural and tourism departments of scenic spots in the jurisdiction, strengthen horizontal communication and information sharing among departments in the tourism industry, and form a governance synergy through a sound coordination mechanism. The third is to promote the comprehensive application of "Dragon Law and Cloud Court". We will comprehensively promote the application of the "Dragon Law" cloud court in 4A level and above scenic spots such as Yabuli Ski Resort, China Snow Village, and Fenghuang Mountain. We will continue to select experienced judges in tourism dispute trials to carry out dispute mediation packages, achieving full coverage of "one scenic spot, one judge" guidance and mediation. In our future work, we will continue to strengthen the judicial brand of "Judge Hao", deeply practice the "Fengqiao Experience" of the new era, faithfully practice the "Two Mountains Concept", and promote the work of the Yabuli Court to create new achievements, write new chapters, and reach new heights.
