On the morning of the 9th, the 2024 Guangdong Hong Kong Macao Greater Bay Area Arbitration "Going Global" Cooperation Development Forum: Technology Leading, Rule Connection, and Guangdong Hong Kong Macao Greater Bay Area Arbitration Alliance Work Conference was held in Hong Kong. Political, academic, and industry professionals from Guangdong, Hong Kong, and Macao conspired to develop arbitration in the Greater Bay Area. "The Hong Kong Arbitration (Amendment) Ordinance 2017 explicitly stipulates that disputes related to intellectual property can be resolved through arbitration, which demonstrates the advantages of Hong Kong law as an arbitration agreement and Hong Kong as an arbitration venue.". Kuang Zhiqiang, President of the Hong Kong Association of Arbitrators, stated that modern cross-border trade and commercial activities often involve multiple regions and laws, evolving from a "one-to-one" relationship to a "one to many" or even a "many to many" relationship. Commercial arbitration can resolve multiple legal disputes at once, and local arbitration institutions have become important institutions for resolving international commercial disputes. In his opening speech, Liang Zhen, Deputy Director of the Department of Justice of Guangdong Province, pointed out that Guangdong, Hong Kong, and Macao have different administrative and legal systems. It is necessary to further study the soft connectivity of the rules and systems of the three regions within the framework of "One Country, Two Systems", the Basic Law of Hong Kong, and the Basic Law of Macao. While maintaining their respective characteristics and advantages, they can transform differences into driving forces, achieve effective connection, and create a good arbitration environment for the efficient and convenient cross-border circulation of various elements, laying a solid foundation for arbitration to go global. The forum held two themed roundtable meetings, where participants jointly discussed "opportunities and challenges for the development of intelligent arbitration in the digital perspective" and "innovative practices for connecting arbitration rules in the era of globalization". Guo Yingmei, President of the Macau Arbitration Association, stated that AI (Artificial Intelligence) technology can enable arbitrators to work more finely, conveniently, and efficiently, focusing more on using experience and expertise to make decision-making judgments. However, attention should also be paid to risk management of the use of AI technology in the arbitration process, including issues such as privacy leakage, bias discrimination, and data abuse. It is recommended that the Greater Bay Area consider issuing relevant guidelines in the next step. The forum also released the one-year achievements of the Nansha Consensus (BRICS Arbitration Cooperation Nansha Consensus) and the top ten classic cases of the Guangdong Hong Kong Macao Greater Bay Area Arbitration Alliance. According to on-site data, on April 20, 2023, representatives of the Nansha International Arbitration Center of the Guangzhou Arbitration Commission and the BRICS arbitration institutions jointly signed and issued the "Nansha Consensus". Over the past year, the Nansha Consensus has been signed and recognized by more than 40 countries and regions including the United States, Switzerland, and Singapore.
