The first fundamental and comprehensive draft law in China's energy sector was unveiled today, and the draft energy law was submitted for review at the 9th meeting of the 14th National People's Congress Standing Committee today. The draft consists of nine chapters and sixty-nine articles, focusing on making provisions on fundamental and major issues in the energy field from a macro level, ensuring energy security, promoting green and low-carbon energy transformation and sustainable development, and promoting high-quality energy development. Improving the system of energy development and utilization is a fundamental element of economic and social development. Energy security is related to economic development, social stability, and national security, and is a major global and strategic issue. The draft makes specific provisions on the system of energy development and utilization in multiple aspects. Clarify the direction of energy structure adjustment. The draft stipulates that priority should be given to the development of renewable energy, rational development and clean and efficient utilization of fossil energy, and orderly promotion of non fossil energy to replace fossil energy and low-carbon energy to replace high carbon energy. Clarify energy development and utilization policies. The draft sets out the basic policy orientations for the development and utilization of renewable energy, hydropower, nuclear power, coal, oil, natural gas, and other resources. Promote clean, efficient, and intensive utilization of energy. The draft clearly states that improving the level of cleanliness, efficiency, and intelligence in terminal energy consumption, establishing a green energy consumption promotion mechanism, requiring energy users to use energy reasonably, and relevant government departments to strengthen energy demand side management. Ensure basic energy supply services. According to the draft, energy supply enterprises such as electricity, gas, and heat should ensure that users receive safe, sustainable, and reliable energy supply services. Strengthen the construction and protection of energy infrastructure. The draft strengthens the coordination of inter provincial energy infrastructure construction, requiring energy transmission pipeline network facility operation enterprises to improve their operational safety level, and no unit or individual shall engage in activities that endanger the safety of energy infrastructure. In addition, in promoting rural energy development, the draft encourages and supports rural energy development, coordinates the construction of urban and rural energy infrastructure and public service systems, and prioritizes the protection of rural living energy and agricultural production energy when temporary energy supply shortages occur in rural areas. One important aspect of strengthening the construction of the energy market system in this legislation is to accelerate the establishment of an energy market system with diverse entities, unified and open, orderly competition, and effective supervision. The draft stipulates that the state promotes the separation of natural monopoly businesses and competitive businesses in the energy sector; Coordinate and promote the construction of a unified national energy trading market; Require energy transmission pipeline network facilities to be opened fairly and without discrimination to eligible entities; Encourage the coordinated development of upstream and downstream enterprises in the energy sector, and promote the coordinated promotion of the entire industrial chain; Promote the establishment of an energy price formation mechanism mainly determined by market factors, and improve the energy price regulation system; Promote international investment and trade cooperation in the energy sector. The draft stipulates the establishment and improvement of an efficient and coordinated energy reserve system, and the scientific and reasonable determination of the types, scale, and methods of energy reserves, in order to fully utilize the functions of energy reserve strategy guarantee and macroeconomic regulation; Implement a combination of government reserves and enterprise reserves, and coordinate physical reserves with production capacity reserves and mineral land reserves.
