The State Council recently issued the Overall Plan for Fully Integrating International High Standard Economic and Trade Rules and Promoting the High level Institutional Opening of China (Shanghai) Pilot Free Trade Zone (hereinafter referred to as the "Overall Plan"). The overall plan focuses on 7 aspects and proposes 80 measures. One is to accelerate the expansion and opening up of service trade. Promote high-level opening up in key areas such as finance and telecommunications, enhance the convenience of cross-border investment and financing, support multinational corporations to establish fund management centers, improve the quality of telecommunications services, and lead institutional opening up in the service industry. The second is to enhance the level of liberalization and facilitation of goods trade. Optimize and improve the import management of specific goods such as imported repair goods, commercial password products, medical devices, and wine, pilot the implementation of facilitation measures such as simplifying domestic quarantine procedures and expanding pre ruling application subjects, and focus on building a scientific, convenient, and efficient management model. The third is to take the lead in implementing high standard digital trade rules. Support the Shanghai Pilot Free Trade Zone in taking the lead in formulating important data catalogs, exploring the establishment of a legal, secure, and convenient cross-border data flow mechanism, accelerating the empowerment of digital technology, promoting the application of electronic bills, promoting data openness and sharing, and building new advantages for the development of digital trade. The fourth is to strengthen intellectual property protection. Strengthen the protection of trademarks, patents, geographical indications, and other related areas, further strengthen administrative supervision and judicial protection, and comprehensively enhance the ability to protect intellectual property rights. The fifth is to promote reform in the field of government procurement. Adhere to international norms, further optimize procurement procedures, improve procurement management, strengthen procurement supervision, and build a standardized, transparent, scientific and rigorous government procurement management system. Six is to promote the reform of relevant "post border" management systems. Deepen the reform of state-owned enterprises, strengthen the protection of labor rights, support international cooperation in the field of green and low-carbon, encourage the import and export of environmental products and services, and create a fair, transparent, and predictable development environment. The seventh is to strengthen the construction of risk prevention and control system. Improve regulatory rules, innovate regulatory methods, establish a regulatory system with clear rights and responsibilities, fairness and impartiality, openness and transparency, simplicity and efficiency, and promote full process supervision. The Overall Plan requires the Shanghai Municipal People's Government to strengthen its main responsibility, establish and improve institutional innovation mechanisms, and solidly promote the implementation of various measures. The relevant departments of the State Council should provide active support, and for those who need to formulate specific opinions, methods, rules, and plans, they should be completed within one year from the date of the issuance of the Overall Plan. The Ministry of Commerce should organize effectiveness evaluations to support Shanghai in summarizing mature experiences and timely replicating and promoting them. (Lai Xin She)
