The Standing Committee of the National People's Congress deliberates the proposed interpretation of the Hong Kong National Security Law

The 131st Chairman's Meeting of the Standing Committee of the 13th National People's Congress was held in the Great Hall of the People in Beijing on the afternoon of the 29th. The meeting heard Li Fei, Chairman of the Constitution and Law Committee of the National People's Congress, report on the results of the deliberation on the proposed draft of the law interpretation of the Hong Kong Special Administrative Region on safeguarding national security, and considered the draft proxy, revised draft, draft decision, draft interpretation, etc. The meeting decided to submit the draft, revised draft, draft decision and draft interpretation of the above proposals to the Standing Committee meeting for deliberation. People from all walks of life in Hong Kong support the NPC's interpretation of the law. Gao Yanming, a member of the National Committee of the Chinese People's Political Consultative Conference (CPPCC), said that Li Zhiying's practice of employing British royal counsel to participate in national security cases was not in line with the original intention of Hong Kong's national security law legislation. The Hong Kong government's request to the Standing Committee of the National People's Congress to explain the provisions of the National Security Law was a correct move in line with the Basic Law and the National Security Law and must be recognized and respected. The interpretation of the law by the Standing Committee of the National People's Congress will not undermine the judicial independence granted to Hong Kong by the Basic Law of Hong Kong. The NPC's interpretation of the law is to provide legal basis for the judicial and administrative departments in Hong Kong, and to provide legal guidance for the citizens. It can be said that the trial of cases by the court and the interpretation of the law by the NPC go hand in hand, and both uphold the rule of law in Hong Kong. Gong Yongde, a member of the National Committee of the Chinese People's Political Consultative Conference (CPPCC), said that the quasi overseas participation did not conform to the original meaning of the National Security Law. The Hong Kong National Security Law was formulated in accordance with the Constitution of the People's Republic of China, the Basic Law of the Hong Kong Special Administrative Region and the decision of the National People's Congress to establish and improve the legal system and implementation mechanism of the Hong Kong Special Administrative Region to safeguard national security. The national security law aims to protect not only Hong Kong, but the whole country. He questioned whether other foreign countries would allow a Chinese lawyer who did not understand the language of the country to defend the country's national security law cases? Therefore, Hong Kong must not set this global precedent. Wang Jixian, president of the Hong Kong Association of Legal Professionals, said that the National People's Congress is the highest organ of state power, and the interpretation of laws is an important power entrusted to the Standing Committee of the National People's Congress by the Constitution and the Basic Law. Overseas lawyers absolutely do not understand the legislative intent of Hong Kong's National Security Law, which would constitute a suspicion of divulging state secrets and lead to foreign interference in Hong Kong. More importantly, Hong Kong's national security law is mainly in Chinese, and the English version is only for reference. Overseas lawyers cannot effectively and accurately interpret the Chinese provisions to defend Li Zhiying's case. Gao Songjie, co sponsor of Hong Kong Re departure and vice chairman of the Hong Kong Elite Association, believes that allowing overseas complaints to participate in the case runs counter to the legislative purpose of the Hong Kong National Security Law to prevent foreign or external forces from interfering in Hong Kong affairs and to protect state secrets from leakage. As long as overseas enterprises leave Hong Kong, they can hardly be bound by Hong Kong laws or professional codes. It is more likely to attract Western anti Chinese politicians to stigmatize and discredit Hong Kong's judicial system, and external forces take advantage of the situation to intervene in Hong Kong's justice, leading to national security risks
