In order to guide the financial companies to operate in compliance with the law and continue to operate steadily, the CBRC recently revised and released the Measures for the Administration of Financial Companies of Enterprise Groups (hereinafter referred to as the Measures). The Measures further strengthen the main responsibilities of financial companies, focus on serving the internal group, and return to serving the real economy. At the same time, guide financial companies with good operating conditions to improve the quality of financial services and better serve the real economy. The Measures require that financial companies shall not issue financial bonds, invest in financial institutions and enterprises, guide financial companies to reserve sufficient liquid assets, and strictly control the total amount of external business. The Measures require financial companies to strengthen corporate governance and shareholder equity supervision, and specify that shareholders, actual controllers and the Group shall not interfere in the financial company's business operations, shall not assist member units in any way to obtain funds through related party transactions, shall not conceal illegal related party transactions or conceal the true whereabouts of funds through related party transactions, and shall not engage in illegal activities.
