Making Case Libraries a Booster for the Construction of a Rule of Law China
2024-03-27
As a new window for judicial transparency, the People's Court Case Library, a "rich mine of rule of law", has a continuous stream of fresh materials. It is a new "rule of law product" launched to meet the new judicial needs of the people and an important exploration to further improve the case system with Chinese characteristics. A case is worth a dozen files. Cases are rulers, experiences, rules, and methods. Authoritative and standardized cases can unify the standards of legal application and improve the quality and efficiency of case handling. On February 27th, the People's Court Case Library, which includes more than 3700 cases, was officially launched. This "rule of law rich mine" contains a large amount of authoritative and fresh materials, which can provide authoritative references and guidance for judges to handle cases, and provide professional services for all sectors of society to better learn the use of law. It will become a booster for the construction of a rule of law in China. During this year's National People's Congress and Chinese People's Political Consultative Conference, Chief Justice and President of the Supreme People's Court, Zhang Jun, stated in a media interview that the People's Court Case Library aims to promote the resolution of issues such as non-standard, untimely, unsystematic, inconsistent, and difficult to retrieve case guidance. To ensure the correct application of the legitimate defense system in accordance with the law, the People's Court Case Library has included nearly 40 relevant reference cases. Can it reflect that "the law cannot make concessions to illegality"? Effective references can be obtained from these cases. The case library of the People's Court includes authoritative cases that have been reviewed by the Supreme People's Court and are considered to have reference and demonstration value for similar cases, including guiding cases and reference cases, covering five major types of cases: criminal, civil, administrative, state compensation, and enforcement. Currently, it contains more than 3700 cases, which embody judicial wisdom, have authority and persuasiveness, and have very important reference and guidance value for judicial trial practice, legal teaching and discussion, and public behavior boundaries. Case examples are actually the most convincing. The Supreme People's Court requires that judges must search and refer to the case database when trying cases, and make judgments based on similar cases stored in the database. The mandatory requirement of the Supreme People's Court is undoubtedly of great significance in promoting unified judicial rules and standards, avoiding "different judgments in the same case", and ensuring the correct and unified application of the law. At the same time, the content and format of the cases in the case database of the people's courts have been uniformly compiled, reviewed, and checked, making them more concise and intuitive. This helps the public to better learn and apply the law through vivid and vivid cases, measure and regulate their own behavior, and strengthen the protection of their own rights and interests. In addition, lawyers or parties can also assert their opinions to the court based on the cases in the case library, which is very different from the public cases on the Judgment Document Network. The cases included in the case library of the People's Court are powerful "weapons" for the public to protect their legitimate rights and interests. Strengthen trial supervision and guidance, deepen trial management that conforms to judicial laws, and build and make good use of the case database of the people's courts. The case library of the People's Court is a powerful tool for strengthening judicial supervision and guidance. It opens channels for "recommended cases" and "feedback opinions" on the homepage. At the same time, there is a feedback module for opinions and suggestions below each stored case. After the case is publicly stored, judicial personnel and all sectors of society can express opinions and suggestions on whether the legal application and judgment rules of the relevant cases are correct and appropriate. Any problems will be promptly cleaned up. In response to legal reasons
